Denial rates for H-1B petitions have increased significantly, rising from 6% in FY 2015 to 32% in the first quarter of FY 2019 for new H-1B petitions for initial employment,” according to a National Foundation for American Policy (NFAP) analysis of USCIS data in the H-1B Employer Data Hub. “Between FY 2015 and FY 2018 the denial rate for new H-1B petitions quadrupled from 6% to 24%. To put this in perspective, between FY 2010 and FY 2015, the denial rate for initial H-1B petitions never exceeded 8%, while today the rate is 3 or 4 times higher.”

      The denial of stamping from india is completely different than h1b reject when applied. They put ur application in administrative processing while stamping, if u mentioned stuff related to security/ encryption in ur resume or ur name matches closely with a criminal. In those cases they will give u visa but after some more processing.

      Basically the officer didn't know that backlog for green card existed. The VO was suspicious that he didn't get his GC till now. 🤦🏽‍♂️

      Another of my friend had similar issue (also from Google). This person had AP and the officer who interviewed didn't know what AP was. He asked my friend 'what bad thing did you do to require parole' 🤦🏽‍♂️

      All these folks are genuine people who got fucked by the system. Both are in my team of 15 people.

      If you are going to say they are unlucky, but only non genuine folks would be screwed, may be you should be that unlucky person and get screwed . That's when you will learn to have some empathy for these folks.

      Ignorance has been around, but usually folks err on side of caution not denial. With the anti immigrant agenda, the field officers seem to now err on side of denial.

      For that officer it's just one random denial, but for my teammate it was life changing decision, with family and kids studying.

      It's a difficult issue. On one hand, true immigration (making, spending, and investing your wealth & time in the system for the rest of your life) pretty much always strengthens the US. On the other; foreigners coming over to intentionally siphon wealth back to their countries only strengthens the US if the contributions made outweigh the compensation paid.       If you know a little about H1, it isn't same as other non immigrating visas such as F1 where a person can't have immigrant intent. The US Law allows immigration petition to be filed on H1 beneficiary. It allows the person to stay beyond 6 years, in that case it isn't a temporary visa anymore. Makes sense?

      H1b is renewed "conditionally" and you are allowed to stay "conditionally" for 6 years. Thus, even if you we're allowed to stay for 6 years, that may be provoked. Hence this whole stay of an h1b is temporary. I know it cause I was once an h1b. I don't understand why this is difficult to understand

      As a former H1B, it was clear to me that H1B is for 3 years with possibility of extending 3 more years. I didn’t know if it could even be valid after those 6 years. I was ready to come back home whenever I lose a job or H1B is over after 3 or 6 years. I don’t know why so many Indians have different expectations than this. I was just glad to get an opportunity to work at one of the big tech companies. My salary difference between US and home is a lot smaller than Indians. That means it is even a bigger reward for Indians (or whoever are from underpaying countries). I talked with people from Egypt and other African countries, Turkey, Eastern European countries or south east Asia and no one thinks like this entitled. I am curious to know what makes this difference.

I would buy your logic of not feeling entitled if you were to continue on an H1 and be at the mercy of the administration's rule interpretation. So many folks here keep on saying you are not entitled to renewals and all but fail to understand that the only reason these folks have to go down the endless renewal route is because of the decades long backlog. And before you say it's a self inflicted problem because of the mass h1b flooding by Indians, I am looking at each individual separately and judging them on their academic / professional merit and not the coordinates of where they took their first dump. No one is entitled to anything. Would be glad if the path to gc via H1 / F1 / L1 would be scrapped altogether. But having been on an H1 and then having obtained your GC, it's easy to preach / ponder / wonder / sermonize now. I bet you, if you never got selected in the H1 lottery and it was your only way route to a professional career in US you would be talking about how unfair the whole lottery system is and how it's almost entirely dominated by Indians (ironically it's still fairer than the green card allotment process, at least each "individual" has the same probability of getting through)

According to UN human developement index India's standard is living is on par with many undeveloped African countries and the GDP per capital is $2k.       How does country not matter? People have different culture and grew up with a different education system and living environment. They all affect adult life. Otherwise, why would parents even try to educate the kids and make effort to raise them in a better environment? When a single country dominates, it will naturally block others from entering the field. It is human nature and has been happening. Network effect also has cascading effect so the people in the majority groups have it easier. There are many who go through the same level of competition but there are many who benefit from this.
      As a result, the average skill level can be lower than other groups who had to face many more challenges.

      If you think I represent my country - you have an argument for country caps - but if that's the case, you are justifying stuffs like travel ban, internment of Japanese in 1950s and so many other shit.

      In a employment green card - to vet skills and then say you don't belong here because you were born in a country is not only unfair, but cruel to folks who can't fix an immutable skill - it's not like one can fix it by being born in another country.

      Again - I am applying for green card - not my country. What my culture and diversity does is a valid discussion on a diversity GC. Employment GC has a good reason it's called employment - my skills are vetted.       Again, neither do other immigrants have rights to change law (they do have first amendment rights just like me).       tTLs, the current system is not even remotely merit or we would not be getting the stuffed shirts WITCH companies send.

      A country cap would increase the merit of the applicants by excluding those barely competent spam applications, ie, by reducing fraud and gaming.

      You seem to have ideological problems with the cap approach, but it would work. It also would work great together with a points system: take the top 10% from each country, rather than overall, and you will get better people than if you just took top 10% overall, due to reduced gaming and the the fact that the top 10% of humans in one country are likely just as smart as the top 10% in any other country.

      It's not likely all the smart people are in one country and if that's the result you seem to be getting you're being scammed.

      Note: this is how Texas selects college students: the state colleges take the top 10% of students from each school district. That eliminates gaming, funding differences, etc, and just gets the smartest kids in. One district might have higher scores overall but that's likely due to factors other than IQ. Same concept here. Geographic caps improve applicant quality.

  • Immigration via h1b has always been a game of significant chance, but since it was a clear and practically sure path to permanent residency for decad a now, for most h1b immigrant, it was practically an immigrant visa, even though it's explicitly a non-immigrant visa.

    USCIS should advertise prominently that an h1b is temporary and renewals aren't guaranteed. It's hard to plan a life with a family and career if you have to take a gamble on a finicky federal government agency granting you a visa.

    I'm an immigrant. Came to the US on a student visa for a PhD, then worked with an h1b for 6 years, got a 'Green Card', and a citizenship 5 years after.

      For example, we have career-level, non-tech employees that will take a demotion to become software engineers. They are put into entry-level SDE roles that are usually given to college grads, despite the fact that the person has many years of experience and should be placed into a higher job level. We also have H1bs who take SDE positions with degrees in subject areas completely outside of computer science, EE, etc even though there are native-born, US citizens who already have the relevant academic credentials on the team.

      I can completely understand now why the H1b renewals are being denied at a higher rate for the folks at my company.

I had an stellar employee get an RFE for his renewal and honestly even i would have denied the application based on how poorly it was written. Fragomen does cookie cutter applications and deservedly we get the higher denials. I wrote the response to the RFE and got a speedy approval.

    My h1b was denied last year. And the words from USCIS basically mean my job at the time does not need a bachelor degree holder to qualify (Shake my head. What an insult to this profession!). Hence, not qualify for an h1b occupation. BTW, last year I was working in a HQ of a giant retail company (you know what it is) as a Data Scientist (exact official title) with level 4 wage on LCA. And I just graduated with a PhD degree in a related STEM field the year before. Speechless, and I left the company immediately for a better job. Hopefully there's no such nonsense this year.

      BTW, the lawyer did a horrible job preparing my petition. I eventually got a copy of what they prepared for my case and RFE response from my HR. The paralegal won't provide it citing it's their policy not sharing with beneficiary. I almost fainted when I went through what they have done. I can do a far better job with some help from Google myself. SMH. And yes I'm not afraid to disclose the name of the horrible law firm, but I doubt if anyone can do anything about them. It's Fragomen New York office.

Lots of bad experience. they are partnered with Infosys, TCS, Amazon, Cisco, Boeing, Citi, Capital One, etc. Because of those Indian companies they also have a bad name in USCIS. Your case also depends on the law firm attorney who files your case and what's their rejection rate. If it's high, no matter from which company you apply, you'll get an RFE!

      Never go through Fragomen! They'll ruin your case.

      You have a point here. I guess that's probably the case. About the reputation of the law firm attorney. This year, my new employer use BAL. I don't know how it is comparing with Fragomen. Nevertheless, finger crossed that my case got selected this year. Some calculated that there's only about 70% selection rate for advanced degree. That makes me quite nervous and I'll only have one more shot if I'm out of luck this year.

    Pretty sure even Trump and USCIS does not want to fix H1B. Had they been earnest, they could have just come up with higher salary thresholds, or lottery based on salary etc since money is a reasonable judge of who's the best and brightest. No one likes the body shops, but totally banning them would wreck havoc with the Indian economy. Trump cannot afford that, since if India chooses to retaliate many US businesses would loose access to one of the largest open markets in the world. So it's all just posturing and fcuking with the lives and careers of the applicants who actually deserve the visa. I feel That's why you hear so many horror stories of denials to high tc fang employees, ivy league graduates etc

      Clearly it's the consulting companies that are driving the abuse so the easiest fix would be to limit that, or just eliminate it completely.

      Make it illegal to sponsor a visa unless the sponsor will be employer, directly supervise the employee at its own workplace, and be the beneficiary and owner of any work product.

      Alternately impose some kind of cap.

      A country cap would be effective, but perhaps unfair. Another approach would be to cap the number of applicants in each particular job classification, or a cap based on the industry of the employer.

      In the meantime USCIS is doing a good job cracking down as best they can under the existing law.

      I believe that the best and brightest are equally distributed in the human population. So the top 10% of Nigerians are the same as the top 10% of Italians or Ukrainians or Chinese or Mexicans or Indians or Filipinos.

      So I'd rather get the top ten percent from every country and when instead what you're getting is 90% from one country then by definition you are missing out on better people from elsewhere.

      Country cap is very effective for given circumstances and low budget. Average qualification of Indian engineers is the lowest of all. Then it is a simple math. Right now, H1B has 4x applicants than the available visas. Over 70% has been given to Indians each year. If you limit that to 25% for example, you get the higher average from the rest of 75%. For example, if quality score for Indians are 1, and others are 2 (no offense, more than half of Indian engineers are consultants hence low), right now it is 70+30*2=130. After quota, 25+75*2=175.

      Walmart, I am not comparing h1b to Americans. I am comparing between h1bs. Look at consultancies. Do you see many nonIndians? Their qualifications are low compared to majority of engineers from other countries. Other portion of people are direct hires or transfer from India. They tend to (not everyone) have lower credentials. Most of them are not from top universities in India nor have PhDs. Lots of them didn’t even study in Computer science. Some IT management or random major and coding bootcamp.

      I am not saying all Indians have low qualifications (some people seem to have an issue at reading it). From Indians H1Bs, say 70% will have this type of credential whereas only 20% of H1B from other nations.

      I don’t know about Walmart but every one of my colleagues and friends in big tech complains about low quality engineers from India. Google and Facebook seem to have equally good Indian engineers so I don’t hear that complaint but companies that hire through consultancies and transfer where hiring manager has a power to hire anyone tends to have this problem like Qualcomm, Intel, Cisco, Amazon and Microsoft. In other words, nepotism and cronyism cause it and that is not entirely the fault of Indians. Any group with major power would do it. US immigration let this problem go too long and now that it is almost non fixable. Majority of Indians prefer hiring Indians just like Chinese prefer Chinese. That creates a hole to have huge number of less qualified people get hired and promoted.

      It seems that the monopolization of the system by India is due to gaming the system and not really due to merit.

      I like the way University admissions work in Texas: they take the top 10% of students from each school district, rather than the top 10% overall. That ensures they get the brightest in the state, and not just students from the best funded district, or the most affluent district, or the district with the most educated parents.

      We should do the same with immigration. Set caps proportional to the population of every country, and take the best 10% from each one. Country caps plus lottery is kind of pointless, but proportional country caps plus a stack rank on merit would be great.

      That way at get the smartest and most capable people, and not just the ones coming from a country that set up an entire industry just to game the US system.

We even were able to get an O1 for a colleague who didn't get through H1 lottery after multiple attempts -- entry level PhD with 2 papers and 50 citations; nothing out of the ordinary.

      Aww man that sucks. Did you go for EB1A or EB1B? A is quite crazy at Nebraska, but I was told by non-company lawyers B was okay (company lawyers suck and would always have a negative opinion).

      I have my own B application under review now, which I was able to get them to sign after lot of drama. Anyway, this is my last attempt to be in the US. If it doesn't get approved, then I will start exploring international opportunities.

      The other guy mentioned an outlier when we are talking about general expectation of salary. You said that was well said. You cannot expect the same salary when you come back to India. Just search up the posts about going back to India and see if most of them are finding the salary is the same.

      The one valid arguments you could make is software engineers get paid significantly well compared to average folks in India. None of you stated it. GDP per capita in India is $2300. If tech workers with 5 yoe is get paid 40k, that will be 20x of average and incredible incentive to come back. Sure you could argue about living cost being more expansive in such cities etc. but most of these comments are oh you don’t know statistics!(while stating unrelated stat). Oh you pick up your nose whatever the bull you were saying.. I think many Indians are smart but people here don’t look to be in the same league as them.

    The reason who we are seeing broken behavior at the border, with "legends" getting denied at the border, is that the system is basically failing under the load of a massive denial of service attack.

    Without a change in laws to reform the system, DHS is doing what it can within existing laws to cope with the onslaught but it's kludgey and inefficient and results in failures. Denial reasons can't be carefully crafted to be in the best interest of the country so you get haphazard denials instead.

    DHS is trying to thwart the offenders with creative interpretation of existing law, but it's inaccurate and catches good people along with the intended targets.

    We need to stop the attack, and to stop it properly it will likely need new legislation. Perhaps banning consulting companies from the program, or just imposing a country cap like the greencard has, to contain and limit the impact of the attack.

      It's possible for Congress to craft a law that asserts that the sponsor of the visa must offer full time employment, be the primary beneficiary of and eventual owner of the work product, directly supervise the employee, and pay a wage above the prevailing rate. They could also just authorize USCIS to come up with an operational definition of "consultant" and let USCIS adapt that definition on its own to respond to changing tactics, giving front line agents broad discretion to determine who is a consultant and deny them.

      But that would require a new law. DHS can't do anything like that without a new law, so they are basically trying hacks under the current law to deny as many of these people as possible, but those hacks also catch a bunch of good people as well because they can't be crafted to narrowly target the abuse.
