Investigation has found that the administration, with their new rules and policies, has been denying visas to experienced, well-paid workers, many of whom have degrees from American universities and have previously received H-1Bs. There’s been an explosion of H-1B related lawsuits filed against USCIS under the Trump administration alleging that the agency has been making inconsistent and incorrect decisions, ignoring evidence, and misapplying the law. Here's the full story: https://www.motherjones.com/politics/2019/12/trump-h1b-visa-immigration-restrictions/?fbclid=IwAR2iJigX0vO0YqoEwSGuv3IXx9kU7rKePsR4iXVpIstkXVGGd5Cpp_geBn8 And here's a twitter thread with examples of illogical, unreasonable denials: [https://twitter.com/cynduja/status/1201605471427350528](https://twitter.com/cynduja/status/1201605471427350528?fbclid=IwAR2o2iK-WJNI_6hIY8OBG-2Dcx2FOGTrJfZT63OAMGyGc-fJLqx_cxXfEdQ)
When you ask an average American what’s h1b? You know what they say? “Oh the takeover of IT department by Indian low wage workers!” I am myself on h1b from India but I have many other coworkers on h1b from countries other than India and China and none of them has gotten any rfe or denial when doing transfers or so. ..
If they are your coworkers, i.e. currently work in the US, sure thing their visas weren’t denied dumbass.
Lol kettle calling pot black.. I knew people at amazon had very poor comprehension skills but you just proved it.. Do you even understand what’s the point here? The op says even extensions and transfers are being denied and that’s what I said.. since you failed to comprehend I am reposting it. “”I am myself on h1b from India but I have many other coworkers on h1b from countries other than India and China and none of them has gotten any rfe or denial when doing transfers or so.”” Read the last 3 words..
A couple of things here: 1) denials are not raw numbers, but percentages, so the rate has increased. This means that when someone gets through the lottery for a first time H1B and gets denied, the visa will go to someone else. There's a lot of demand for these visas, so the overall new visas issued won't go down so easily. But, the investigation has found that the agency has denied qualified candidates who shouldn't have been denied in the first place 2) the denials are for first time and renewals. In case of renewals, there's no lottery process and they've been issued H1Bs before but those denials are also going up. They don't look at state issued visas, but my guess is they'd be going down because of the denials of the renewals and H1B transfers
Stop whining... They can deny whoever they want at their own discretion, it’s part of the law. Looking at individual cases doesn’t make any sense because immigration laws are supposed to be better for the host country on the majority case, so there will always be an unfair statistic level.
Don't tell me what I can and can't do. If I want to whine, I'll whine. Btw, it's not part of the law to deny at their discretion AND the piece just doesn't look at individuals. They analyzed all the lawsuits filed against USCIS.
I thought trump was good for Indians, no? I saw tons of posts from Indians saying how trump was good and democrats were bad. What happened?
Somebody at USCIS or the administration needs to speak up that the existing laws are not able to combat H1B and EB1C malpractices that Indian consulting companies routinely do. Until that happens, genuine Indians will continue to suffer.
U know USCIS isn't a law making body. USCIS can scream on the top of their voice and nothing will happen. It's the congress. This is why you should ask if any bills that you support w.r.t to these issues actually have any h1 abuse prevention provisions. Genuine Indians shouldn't be suffering. Integrity of the system is everyone responsibility. Everyone who applies in the system is an individual applicant. Their country didn't conspire to send them nor do they represent their country. They have a skill that is why they get eb green card. Country of birth has no place in employment (EEO laws) and have no place on a skills visa.
Country of birth and citizenship will always be an essential part of any immigration system. Also don’t forget that is not only genuine Indians getting the negative side effects of Indian scammers.
Incompetence and malice make a great combination
I don’t believe getting an American degree makes you deserve access to the country outright. Our country already only works for the 1% of America - I don’t need it dedicated to the 1% of the World instead.
Same number of visas are granted. ICC approval rate go down, FAANG companies go up. Simple as that. It's totally the right thing to make sure the applications are not fraud. ICC used to flood the field with low wage workers that's detrimental to local market. Disney was reported to give domestic workers pink slip and ask them to train H1B workers for transition or they won't get severance.

Correct me if I’m wrong but the same number of visas are ultimately approved, right? So this just means there are more applications and consequently more denials?
No... the same number of visas are “applied” every year. The application can either be approved or denied . Recent years have seen a significant increase in visa denials .
The visa quota is being the same since 2012. So yes, same number of approvals.
