My friend works for a nontech company and doesn't have many people on blind. So just asking on his behalf. He has a notice period of 3 months and he is extremely frustrated at his current job. He has been trying to find a job but almost nobody wants to wait that long. Finally, he has landed a role in a tech company but he told them the notice period was 1 month during the interview process. He wants to leave the current company ASAP and doesn't care about the dues or remaining pay. For the record, his boss has never allowed anyone to leave before serving 3 month notice period or accepted buy out option. He wants to leave and doesnt want to bring up 3 month notice period to new employer. Can he just leave the current firm? What's the most his company can do? Can they ask for termination from new employer if they find out? He is ok to pay 2 months of pay in damages if these things go to court. But wants to know if anyone else has heard of companies suing former employees or worse affect their new jobs . P.s. trolls, I dont know his TC... so please dont ask.
What country is he in?
This has to be an IT service company.. they’re the ones that have three month notice periods.. ridiculous! If your friend doesn’t care about his final paycheck, just ask him to leave. Toxic work places are horrible for your health and mind, just get the fuck outta there

Which State is he employed in?
If it is California, he can leave after getting the month end salary and no notice. Yes you will burn bridges, but it is 100% legal. I don’t recommend burning bridge if you are on h1b as you may need letters from your previous employer for a green card.
It should have been simple if he told to new employer and asked them to pay for that buy out. All company does it if I’m correct. For now, I believe he need to confirm what really the contract says. If there is option to pay out, just do it.

I just left a job with 3 month notice period in Texas. Hated every single moment of my life there. I served 1.5 months and then couldn't take it anymore. Company tried to threaten saying because business continuity is affected, they can sue me. They didn't do anything, but I probably can't ever give a reference at that job. However happy life > reference
Check employment contract vs labor law. Any contract should have an exit clause.
