Notice period

My friend works for a nontech company and doesn't have many people on blind. So just asking on his behalf. He has a notice period of 3 months and he is extremely frustrated at his current job. He has been trying to find a job but almost nobody wants to wait that long. Finally, he has landed a role in a tech company but he told them the notice period was 1 month during the interview process. He wants to leave the current company ASAP and doesn't care about the dues or remaining pay. For the record, his boss has never allowed anyone to leave before serving 3 month notice period or accepted buy out option. He wants to leave and doesnt want to bring up 3 month notice period to new employer. Can he just leave the current firm? What's the most his company can do? Can they ask for termination from new employer if they find out? He is ok to pay 2 months of pay in damages if these things go to court. But wants to know if anyone else has heard of companies suing former employees or worse affect their new jobs . P.s. trolls, I dont know his TC... so please dont ask.

Check employment contract vs labor law. Any contract should have an exit clause.

This has to be an IT service company.. they’re the ones that have three month notice periods.. ridiculous! If your friend doesn’t care about his final paycheck, just ask him to leave. Toxic work places are horrible for your health and mind, just get the fuck outta there

But can they reach out to new employer as he will essentially be joining within notice period?

Amazon silver_fox Apr 2, 2019

I can’t answer that but legally there is nothing they can do. If they reach out to the new employer it just reflects badly on them. Please tel me what company this is. You can dm me

Which State is he employed in?

Amazon @hq3 OP Apr 2, 2019

New york

Samsung Grfgju34)@ Apr 2, 2019

NY is at will state. This should have been stated in his offer letter. So, he can leave anytime he wants without notice.

Samsung Grfgju34)@ Apr 2, 2019

If it is California, he can leave after getting the month end salary and no notice. Yes you will burn bridges, but it is 100% legal. I don’t recommend burning bridge if you are on h1b as you may need letters from your previous employer for a green card.

It should have been simple if he told to new employer and asked them to pay for that buy out. All company does it if I’m correct. For now, I believe he need to confirm what really the contract says. If there is option to pay out, just do it.

The manager doesnt agree for buy out it seems. Toxic manager Nd toxic firm

This seems very odd for a US based employer.

He should then get fired. Show up late, violate company policy.

Amazon @hq3 OP Apr 2, 2019

Lol, that takes time...... especially if you have been doing well all those years. Even at Amazon we cant get anyone fired that quickly, lol

I just left a job with 3 month notice period in Texas. Hated every single moment of my life there. I served 1.5 months and then couldn't take it anymore. Company tried to threaten saying because business continuity is affected, they can sue me. They didn't do anything, but I probably can't ever give a reference at that job. However happy life > reference

Amazon @hq3 OP Apr 2, 2019

How long were you there

Amazon wassup! Apr 2, 2019

Served 1.5 months of 3. Was in the company for over 2.5 years
