I just got an O-1 and my spouse an O-3.
My new employer will apply for a GC when I start.
Has anybody any experience with filing for a GC for your spouse (O-3) at the same time and getting an EAD for her while the application is pending?
- Amazon / ProductUlub72Regardless of your status they can add your spouse to your application. A person above correctly answer you about priority day. It will impact if she can get ead (not h4/o3 ead but green card ead which usually is faster than a GC)
- You should be legal married. She should be admissible in the us (means not a criminal etc). She just rides along your application. Let lawyers know as they have to still separately add her to paperwork . It’s not an automatic process that someone gets a gc just because the spouse does.
- Google says no. EAD is not available for an O-3.
However, if you’re eligible to file your I-140 and I-486 concurrently, both of you can also apply for an EAD & Advanced Parole for everyone and expect to receive it 3-6 months later.

I clearly stated that this is not about getting an EAD for my wife as O-3 but rather when she is filing for a GC.
So honestly, you just confirmed what I already knew. I do know how to google.
I am looking for people that have done this and hand experiences with this process.
