Regardless of your status they can add your spouse to your application. A person above correctly answer you about priority day. It will impact if she can get ead (not h4/o3 ead but green card ead which usually is faster than a GC)
Ah see. Thanks. What does “priority day” mean? And do you know if she needs to fulfill any special requirements other than being my wife? Or is it all riding on my GC application, similar to when an O-3 is practically just a formality?
You should be legal married. She should be admissible in the us (means not a criminal etc). She just rides along your application. Let lawyers know as they have to still separately add her to paperwork . It’s not an automatic process that someone gets a gc just because the spouse does.
Google says no. EAD is not available for an O-3. https://www.avvo.com/legal-answers/applying-ead-on-o3-visa--3778545.html However, if you’re eligible to file your I-140 and I-486 concurrently, both of you can also apply for an EAD & Advanced Parole for everyone and expect to receive it 3-6 months later.
I saw that too. I am aware that an O-3 can’t get an EAD. That is why I am wondering if my wife can apply with me together for an GC and get an EAD this way.
