My company will file my green card this january. The first process is PERM/labor certificate where they determine a prevailing wage. I believe i am underpaid by around $13k. I wanted to ask for a raise as well and i am wondering that if my prevailing wage in PERM comes higher than my current wage is my company obligated to give me a raise without me asking? Or do i make no sense and this is not what prevailing wage means
You can look up your prevailing wage on DoL. That’s no secret. If you’re not a new grad and an IC, your level is probably 2 or 3.

Perm is future employment so can be different from current salary.. salary change happens when your salary is not matching the current h1b lca salary for that level and wage code.

I did the process with my company a few years ago, and my salary was like 10k low, when the labor department set the salary for your position, that btw can depends of multiple variables, and also the company can manipulate it, YES the company needs to prove that your salary is the same or more to continue with the perm process. Part of the process is to include pay stubs with that salary or more, so there is 2 options give you a raise or cancel the process. I have friends that their process was canceled or started again to try to get a lower minimum salary.
Attorney wont disclose if you are underpaid by how much. Haven’t seen raise in this situation
