PIP + Visa - Getting ready for the roller coaster ride

Hello Fellow Blinders, I was just told that I will be on PIP. No documents have been signed yet but manager said it will be done soon. I’m on a visa like most of the folks over here and as someone getting soon on pip I’m assuming I already have 1 foot out the door. The slightly good part is that I already have a job offer aligned & they have started some process like background investigation and hopefully the visa transfer intake process will begin this week if not max next week. Manager said he’s going to provide me only 1 month days to successfully appeal pip. I’m trying to push him for 2 months for the pip so that I can have some cushion in the form of visa filing and all that kind of process My questions: 1. When does the PIP start? From the day he told me he is putting me on PIP or when the actual document is signed? 2. If new company files for petition; I receive the receipt notice but not a decision yet, should I join the new company on it before getting piped out 3. Does anybody know if the decision is RFE and I’m still with old company assuming I have few days left before they terminate me, can I still join or have to wait for the decision ? Any other things to look out before signing the PIP? I suffer from anxiety and this has started to stress me out but I believe I should be okay. Thank you all in advanced. Yoe: 5 TC: 130K

Push other company to file documents asap. PIP started already. 90% chance that you ll get fired in less then 30 days. You can join on receipt, or wait till you officially fired - up to you.

You more than likely will NOT get severance pay. Most companies do not pay severance for a performance-related exit.

No. PIP will last at least for 30 days. They pay severance at the time of termination. By then he should at least have a receipt.

Your manager can fire you anytime. If I was you, I would have asked the new employer to file for premium. If they don’t, you pay $1200 and get it transferred within 15 days.

The new employer is going to file in PP. This week end would probably be lca filling with next week should be petition filing. But timelines could extend by a week for everything. Once the petition is filed , and if I get fired, I still would be legally entitled be in-status right?
