RFE during H1B transfer
I received an RFE on my H1B transfer application. (Premium Processing) I’m working with Fragomen. Does anyone who has been in a similar situation know how soon this can get resolved. Fragomen has been very vague in their answers
Takes 2-3 months. Attorneys will take at least a month to reply to RFE and expect another 2 weeks before you can hear from USCIS.
If the rfe reason is specialty occupation, expect 3 months. Fragomen takes that much time to prepare a response then file right before the deadline given by USCIS which is 12 weeks.
Did you apply for swe or hardware engg role?
I have a question, I got my transfer approved after rfe on dec 20. But the validity date starts from "20 oct 2019. I have a new joining date of feb 15. The attorneys pointed that according to uscis rules, the employment should within 60 days of validity start date. That's not gonna happen in my case because, the rfe response was not even sent by then. Are there gonna a be any issues if I join the new company or is it ok to join?
Hi OP, did your rfe got cleared? How much time it took? I am in the same position. Fragomen team didn't even sharing the copy of filing so that I can review and see myself what could have went wrong.
These days its a gimmick to buy them more time i guess. But you have also not shared what rfe is about and what your background is so hard to tell. Also please tell me you didnt join on receipt
why dont join on receipt?
