Is it possible to legally work in the US on a E-2/H1-B visa and at the same time have a startup in a different country?

For the H-1B, my understanding is that any work done on US soil must be for the employer hosting your visa. There’s been conflicting opinions online (a bunch on Quora) so I’d appreciate if someone has a concrete answer on this

Yes this makes sense. If it were legal, every L60 and above would have an independent Dev shop doubling his income.

^ true. I wonder how many people still do this though - there’s no way the US would find out is there?

I believe you can be part owner in a business anywhere, H1B laws just prevent you spending your own time on it.

You can run any legal business by hiring a manager. As simple as that.

Yes, as long as you don't do any actual work on the startup while in the US. You can be a passive investor in the startup while in the US and you can actively work on it while outside the US.

I think so, but you should talk to a lawyer. You will also need to pay US taxes on everything you earn abroad, so watch out for that.

Yes. But you will need to declare your income from the other country (if any) in US income tax returns.
