Yeah we should also solve world peace along the way. Amazon doesn't understand laws - it's impossible to make a law that puts caps on h1 survive courts. That's because it goes against EEO laws. Besides, realities in the Hill dictates companies will lobby hard against the bill that you can never ever be able to introduce it, forget about trying to pass it. Keep suggesting roads that go-to nowhere.

I see people screaming left right center that we need a merit based system instead of S386, but I have a dumb question - if Employment Based Green green card's EB1, EB2, EB3 aren't merit based categories then what are they?
The issue is the country caps. A true Merit based system will not differentiate between countries. It validates your qualifications based on standardized criteria which is hopefully unbiased.
Fantastic question OP. The folks who oppose want to retain caps because even though there were candidates who applied before them, the only reason they got ahead was their country of birth. They will tell u that the EB criteria isn't enough. But what they propose will be either roads that lead nowhere or bills that have 0 chances of passing (effectively they want to maintain status quo so they can continue to be treated special). Some folks will go the extra mile to say everyone else other than them are low skilled and such. That's how they see others - hey I am special everyone is beneath me. They have that chip in their shoulder that they are special. Equality is something that they can't visualize. Don't question them with actual data that shows that the last 5 years, majority of candidates from their country were folks who were unskilled (yes eb3 allows unskilled and that's one way some get ahead). Today an unborn kid in non backlogged country will be born tomorrow, go-to school , come to US and get Green card ahead of me, even though that person hasn't contributed anything to the society here yet. In the meantime, my work at a top tier company doesn't matter. My taxes, which is much more than what these folks would contribute in a decade doesn't matter. My contribution to my local schools by volunteering, my donation to the charities and the time I spent being part of the local soup kitchens here doesn't matter. My contribution to local community - NONE of that matters - I happen to be born in a populous nation and that I should be punished for it. The wait time today is 150 for eb3 and 70 for eb2.
