So under my given circumstances of work (h1b) visa restrictions (and waiting for lifetime for green card), I cannot simply start a business in United States on my name. But, I can under my spouse's name (who is on EAD, legally allowed to start a business) Now, me being a techy guy, unlike my wife, can anyone suggest me what is the best way to start a business under my wife's name, so that I don't get deported and lose my job? Has anyone else done it? How do I market my app, as my wife? How do I interact with customers?
U will be the follower which I think most do to their wife.
Hold on. H1 and h4 has similar work authorization, no?
Nope.
You should be deported then jailed immediately
This is a bad idea. There are plenty of countries which will give you an entrepreneurs visa, but America is not one of them.
Don't do it until there is see clarity on H4 EAD. Also H4 is dependent on you maintaining your H1. So you won't be ever able to work full time for that company.
Non-US person can also create company in the US. Google it
On what basis did you make the decision that you couldnât register the company in your name?
H1s can open company its just you can't work for it. Hire people and you just provide leadership or management.
I talked to a lawyer about this , just open a LLC in her name . You cannot get paid or show that you had anything to do with the app. You cannot work for the company in any capacity (not even management or leadership) , also her EAD is dependent on you maintaining status , so if you lose it then she cannot pursue the business anymore. I did not ask her about the volunteer angle .
