Hi all, I’m accepting an offer today and have a dilemma regarding some shares at my current company. After years with no raise, the company granted some additional shares as a raise but they came with a one year cliff. The shares vest on 12/14. I am accepting an offer with a start date of 12/17. I have two options 1. Give zero days notice on 12/14. I get the shares. 2. Give 2 weeks notice on 12/1. Maybe they say “Today is your last day” and terminate me immediately. Giving zero days notice is shitty but my boss is a douchebag and will be happy to screw me out of my shares. I really like everyone in the company besides him and don’t want to be the guy that gave zero days notice. What would you do?
Just call the new employer and extend the joining date. State the reason and if they don’t understand then atleast you know where they stand.
I already asked and they said I must start before 01/01/2019. I’ve already paid for a vacation from 12/21 - 01/01. That would mean I have to start the week of the 17th. Also, if I give notice on 12/14, it’s effectively only one week notice because of the vacation.
this happened to me. new company was happy to push start date. just ask them

12/17 is a terrible start date anyways. Just start with the new year :)
The new employer said I must start before 01/01 and i have a prepaid vacation from 12/21-01/01

They caught wind or suspected your intent to leave. Classic tool from the box, don’t be cheap. Think long term.
This doesn’t make sense. Are you suggesting they knew a year ago?
Do you care to come back to the company you are leaving? If not, give one day notice. They would likely screw you given the chance.
I wouldn’t come back but I care what people there think about me.
If they are worth caring about, they will understand.
Give 0 notice. If your manager is really that bad he/she would probably arrange it so you would not get your shares.
Can you start on paper on 12/31 and agree with your manager that you burn two days of vacation right away? Then physically go to the office Jan 2? Sounds like they need to start you by then so they don't lose their budget but it would be surprising if you had to physically produce work for those two days.
Thanks, I’m asking about this
Take two weeks of PTO before you vest. Notify everyone of that. Or just say I'm taking a 3 month sabbatical starting on whenever you would have said your notice is.
Our handbook specifically states that you can’t use pto during your last 2 weeks
Only if they know it's your last two weeks. It sounds like the company or you manager doesn't have the trust of it's employees to not screw them. That's an unfortunate culture. You should do what it takes that's best for you. If you don't care about burning some Bridges to get some stocks then do it
You can prepare your teammates for your departure without formally submitting your resignation. So if you care about their opinions you can put in some extra time on writing docs and training over the next couple weeks and still give one-days notice to secure your stocks.
There’s higher level people that I can’t “prepare” beforehand and I care what they think. These guys remember everything and won’t look kindly on zero notice.
That's unfortunate. May not be a clean solution then. Good luck!

Try and push out your start date out. The new company will understand. Just be transparent with the new employer.

Wait, one week notice and vacation? Do it, who cares. You made it sound like zero days notice.
