Asking for a friend: For h1b my friend got rfe and responded to it late last year. His company will be upgrading to premium processing, the lawyer says no need to send rfe response AGAIN with request for premium processing but the lawyer is pretty useless his applications have been imcomplete in the past. Wanted to check if he should request his employer to include rfe response with the request for upgrade to premium processing as well. Looking for honest suggestions. Trolls please stay away, it’s a very stressful situation for him. Thanks TC: 200k/6yoe
My suggestion would be for him to contact his employer and talk to them for processing it in premium. If that doesn’t work out, let this go on the side and he can prep/interview with other companies. Some employers just listen to what their lawyers have to say.
There are two outcomes of an RFE response: approval and denial. It's this "friend" hoping to speed up the approval for some reason? What's current impact, is it delaying them from doing something? As for denial no idea why you would want to speed up a denial.

As far as I know USCIS won’t start his premium clock until RFE response is received or due date for response is past
Rfe is already responded to. The question is does he need to duplicate it with the premium processing request
No. So current status must be “response to RFE received”. Just request for PP, they have all they need for application.
