What happens when you don't qualify for FMLA

Wondering what happens when you join a company that has FMLA rule and you are expecting. Will you get any paid leave or job protection? Context: I was contacted by recruiter of a new company of my interest, but we are also planning for a baby. Wonder what I should/should not ask and how to have all relevant information before even considering going through a pretty extensive interview process

why wouldn’t you qualify for FMLA?

FMLA has 1 year of employment requirement, what if you start a new job in your first or second trimester?

hmmm, best resouse is tocheck w HR. If you are in CA you’re protected for at least 6weeks, but I think the pay is lower... You won’t find the answer in Blind. Check with your HR

Job isn’t protected.

It depends what the companies terms are for their portion of it. In California you qualify for the state sponsored 12 weeks (6 are paid at 55%) if the company has over 50 people, you've been there for over a year, and you have a year from the birth to use it (there's a couple of other things too but those are the most important).

Yes I'm wondering what happens if one is at the company for less than a year?

You can't get state sponsored FMLA then. You have to have been at the company for a year.

If your are in CA then you automatically qualify for Pregnancy Disability Leave (PDL) which is job protected (but not from things like layoffs). Check your company handbook LOA section. It’s possible that your employer has their own maternity leave offerings.
