I applied for 3 weeks of PTO in the last weeks of December lat year. He wasn't happy about it and told me that it wasn't meant to be availed completely. He refused to encash or carry it over to the next year but rather wrote in my performance review that I left on leave suddenly without approval. What should I do? I complained to the Senior Director but he's a good for nothing and just refused to listen. Should I complain even higher up or should I consider a lawyer?
A) managers can deny your PTO B) donāt wait until December to use it all. C) donāt use it all at once and expect the manager to not say āsomethingā about it. The more you want to use at once, the more notice you should give. December was 4 months ago and you should be over it by now.
They have to compensate for it if they deny it with a good reason. They can't deny and not compensate it, at the same time. Right? Any such guidelines of when to apply for it or how to apply for it, need to be given in much advance. If manager doesn't, it's his fault and he's the one who should be paying for it. It was 4 months ago but I haven't got rid of that guy yet, and he's hurt my performance review and financials very bad.
No they donāt. You arenāt entitled to use it exactly when you want. Business needs always come first.
I wouldnāt think of lawsuits for something like this. you can burn bridges and create a reputation you donāt want

is not going to be the last time youāre treated unfairly. is going to happen in many ways. you canāt sue everyone that treats you unfairly at work. legally is really hard to prove and soon nobody will hire you. I would find another job and move on
You don't ask for leave, you tell them and make a plan for your absence. You're screwed in this case with a nasty manager. Not much you can do other than documenting your progress officially through the year and getting visibility with manager's boss.
That's what I did. He said it was on a short notice, without ever telling me what's the right notice period. His fault not mine. He should have known that folks in his team have PTO that they are very likely to avail towards the end, in all likelihood.
Making a plan to cover for you is also your responsibility as much as it is the manager's. You seem to have messed up that part, but not letting you encash or carry forward is just hurt-ego.
You clearly are not a team player. Put yourself in your managers shoes and think how heād have to handle all the priorities at that time and one engineer is suddenly gone on vacation for 3 weeks with a short notice. Had you given him more time, he could have planned to make sure things go smoothly but you threw him under the bus on a technicality and now you feel he should be happy about it ? Just suck it up and try to think about not just yourself but your team as well
The problem is with business, they should adapt. It's not about the team, it's about the money that greedy corporates, the best in example being Apple, that these business stash, while denying the promises to the employees. They should have known that I have leaves that I'm gonna avail. In Germany, my friend told me that they forcefully send you on leave, if you have remaining PTO towards the end of the year. It's not me vs the team but the greed vs my life.
Afaict the problem is about you not treating your manager like a human being who has his own sets of challenges but like a villain who can see the future and despite having this superpower of seeing future heās doing everything to deny you your right. You need to stop smoking whatever it is you are smoking and get sober
Y'all need to read his other thread ("should a PM give feedback to engineers") and you will get a better understanding of OP. He honestly sounds like a very toxic person to work with.

Trust me, I'm not the toxic one, just because I'm attempting to understand and improve. If you want to know whether it's me or the organization, just check the bad Glassdoor reviews. Such toxic people and places exist and can survive, is the biggest problem.
Man, this is at least fifth post about your manager/review. You need to change job. Regardless of how much that review was deserved or not, you're not mentally at a good spot in your current role.
Rights and responsibilities are complementary. Your manager is right... its not supposed to be abused. A lot of firms now allow unlimited time off / flexible leave policy. Doesnāt mean you can take 2-3 months off every year to travel the world. Next time get sign off in email or your HR absence manager tool.
It's not unlimited PTO that I'm talking about but fixed PTO. I'm not abusing them by availing them at the end of the year - the last chance to use them. They refused to compensate or carry it over. Why should I not avail, what I'm entitled to?

This doesnāt sound like a lawsuit. Sounds like you should give a better heads up next time. Three weeks is a long time to be out at any time, but especially the end of year when people are trying to wrap things up. I could see why they were annoyed if you did this without much warning or planning.
Change teams or company. This sounds like a toxic environment, not worth it.
