I saw this chart online. I am now in the process to start my green card application and I am from Europe. Does this mean I wont get my green card in 10 years at least?

      Well Indian companies were gaming the H1 system, i.e. multiple H1 B filings, fake IT consultancies. It's not pay back time in fact, it's the same people taking advantage of the system but ruining it for everyone else.

      The wait time will increase both ways, unless you just want to say a big fuck u to all the people who have aged out of the system after the merit based immigration law gets enacted. Do you think US will offer 300k employment based greencards per year to keep it current. This is not fair to them as they have followed the law from past so many years.

      Also no one has any idea what merit would look like and how are you going to judge a degree/phd from a low university to standford. Also not all people graduating from a low university is incompetent.

      Its better to let this bill pass, bring everyone to the same level and then enact merit based system in the meanwhile.

      We need to get the needle moving somewhere. This has bipartisan support, no other immigration bill has that, and all attempts to do comprehensive immigration reform has failed to get any support.

      From my understanding only new people will have to wait. When a new system comes into place they will inevitably have to process the backlog. Also these is a huge difference between waiting 10 years and waiting 40

      Background checks as the name indicates happens in the background cross referencing various federal departments. How would you know it’s a joke unless you yourself gave fake information?

      I am not saying they are not lenient for some nationalities but for Indians and Chinese it’s definitely not given the “fake consultancies” is a known issue.

      The only problem I have with your statement is that you make it out to be that Indians are at fault and so their plight is irrelevant. I wish that everyone regardless of their nationality be treated equal if they can do the same work.

      @A10 networks I think you're addressing my comments halfway through your post. I didn't fake any information. I'm reiterating the point that the checks can be random and more needs to be done to weed out the culprits in the H1B process. Doubling/tripling the number of candidates from one country increases the chances of more of those folks getting H1B's and adds on to the GC issue. I can agree that the cap per country is outdated from a GC point, but you also can't deny that the problem isn't also manufactured from the H1B, further up in the funnel and yes majority from Indian firms.

      Hence why I think this bill is a half step that doesn't address the root cause of the issue and unjustly punishes people who didn't do anything wrong.

      The whole reason this system works is because people are tied into slavery.

      Lets assume infosys in the bad guy here. If all infosys employees who are moved to US on H1B can get GC either by switching to other employers or filing on their own. They will leave infosys first thing they come to US. This takes away infosys incentive to bring them here.

      And hence we will see a reduction in these consulting companies bringing them here, as they will not be able to keep these employees tied up and offer them low wages.

      The longer the people in backlog the more people infosys will keep on bringing and hence the H1B lottery will also be a thing forever.

      @LinkedIn you need sources when someone said fake resume and fake credentials? How about I have caught multiple guys trying to outsource Skype interview and to be specific from Cognizant ? I have too many experiences that I am not even bothered to type here. If you google few forums you’ll find out how H1B has been abused. It’s them these consultancies that is screwing everyone and even worthy applicants form India.

      I have ask for source that all infosys/tcs employees do that and they are bottom of the pile in competence. There are bad fish in the pond always. Just because few people are doing it, you cannot paint entire employees from all those organizations with same bursh

      Plus I think H1B and backlogs proporgate this behaviour as people are desprate to stay here but cannot stay here if they loose their job/ burned out /in depression etc. In such cases people would have taken a leave of absence and then tried or switched careers. Not having a job here kicks you out of the country and fuels this behaviour more.

    Possible if this bill passes and you don’t get a priority date soon.

    Here’s how it works. ROW gets 15%, 10%, 10% of the quota in the transition years 2020-2022. They used to get 60% to 70% PER YEAR so they will be backlogged somewhere in 2020. And if you didn’t get a priority date in early 2020 the quota could be used up and you are placed behind the massive Indian & China backlog. That means it will take probably 10 years for you to get GC.

      Lets say one files for i140 under premium processing this year. Does that likely mean they'd get green card within a year or two?

      There are at most, 140K x (15%+10%+10%) = 51K GCs for ROW applicants in the next 10 years or so. If you applied after the bill becomes law you’ll need to be among the first 51K ROW applicants to get your GC within the 3 year transition period.

      So if ROW applicants don’t rush to apply for GC, then yes you will get it in 1 or 2 years.

      I would not have minded if not the blatant bias by Indians favoring Indians in hiring and promotion. These people have no shame and don’t care about diversity. They think Indians are the best and keep favoring them. See how many teams are Indian only. It is ridiculous. They are pushing out Americans as well. There are so many political and unskilled engineers from India even at big tech companies. Political game makes everyone exhausted. This is what happens when majority group takes up and keep favoring them. It is like monopoly. There should be something done like country quota on h1b otherwise, you cannot get a engineer job no matter how skilled you are eventually.

      How are you so sure that they always favor Indians? My manager is an American and he feels everyone got in to his team through a fair process. Hell, even he favors some Indians over others(Indians included). Appreciation should be given to those who deserve it and root out the bad/incompetent ones.       It seems mehmeh@ has some other personal issues that are bubbling in the form if hatred towards a community. It’s difficult to identify this maybe due to a bad personal experience but in the most capitalistic country of the world, it’s impossible for businesses to survive without merit. So I would argue as a whole, tech is the last place you’d see such behavior given the innovation and speed of our industry. This is after acknowledging that there are pockets maybe even companies where politics supersedes merit. I hope you realize this and find yourself at a better place where you don’t have to deal with that.

      Btw why do you think its not fair. India is huge country like having 30 countries together. By that measure whole Europe should be considered as same country for GC. Just because a big portion if land is run by one rule then that should not be an excuse for delaying GC. Had British not meddled; Pakistan and bangladesh would have been part of India too. They do not have long waits just because they are today different countries in Indian subcontinent.

      Thats the point. Some companies are making fake resume and salary proof to game the H1b and green card system.     My friend from Europe...you just frustrated by seeing 10 years...over here we are waiting for 10 years...is it ok? We pay the one of the high tax bracket...we have purchased home here...but still you have problem...awesome...you will not need to wait as 15% will be for you but if you need to wait then you need to think how many other we’re in your boat...it’s not your or our problem but first we suffered from broken immigration systems and now you...It last matter of time Country wide limit is going out and we are getting the GC

      Does the immigration system need to be improved? YES! Is the bill the solution? NO! First of all, we need to punish those companies that abuse the H1b system thus the green card process. Then try to clean up the backlog and reform. The bill is not solving the problem but just shoddy lying chaos from one country to another. That’s why the people from all other country are against it.

    This is not fair. Indian consulting companies hire only Indians and none from rest of the world. They are the largest number in GC queue. Now people of 160+ countries will be blocked to make way for giving GC's to those unqualified body shop folks. And you are calling fair?

    They want to have it both - abuse the H1b visa which is the pipeline into GC and then ALSO get all the GCs, claiming "a few" have abused the H1b.

    The thing is: it is the country’s fault. The backlog of India is purely caused by H1b abuse of IT outsourcing companies.

      Okay I see the data. Thats intresting. Atleast for 2018 google had a 99% approval rate
      But if you see the RFE rate, that is at 60% for 2019. Around 40-50% for 2018.

      That is one factor which drives fear as well.
      What if the petition gets denied. And hence a lot of people are hesitant. I know I was.

      But thanks for pointing the stats out. Makes me a bit relieved when changing jobs.
