I have a PhD with a few publications and am working in the same field. What is the likelihood that any of the top companies in the Computer Science/engineering field will sponsor an EB1 application? In other words, I want to hear from people who have had EB1 filed, the requirements that the lawyer put forward for such an application.
Never heard anyone failing eb1 application.
Lawyers should be able to help. CS is competitive. You should have 100+ citations, review 30+ papers for different journals, any invited talks will help, being on a doctoral committee would help. Any national level awards with media reference would be great.
I came to the US under an O-1 and immediately applied to EB-1 once here. Received my green card within 7 months. It requires having a solid publication record with a reasonable number of citations, proof of acting in the evaluation of the work of others (thesis committees, conferences committees, funding agencies committees, etc) and, what was for me the worst part, letters from well known researchers in your field attesting that you are one of the few luminaries in the area.
Google sponsored both O1 and EB1 and I have a few colleagues in the same boat.
Same here.. green card in under 7 months - but had competitors like Apple and Samsung writing evidence that my work was world class
Contrary to the comments here an immigration attorney told me once that getting eb1 green card under exceptional ability category is easier than expected. It's not just the no. Of publication. Hire a good immigration lawyer to help you.
Thanks for the replies everyone. I have a few colleagues in other companies like Qualcomm, which do it more easily than others. So I was looking to get a sense of this company to company difference. From what I hear, a good publication record with references might be good enough... Is it correct to assume that the lawyer has a big time to play in this process?
Lawyer does not matter. Your ability to get reference from international sources praising your research contribution matters. Also serving as journal and conference reviewer helps a lot because you can ask the associate editor or program chair to write you a reference letter.
Depends on competition in field for example chemical might be easier than CS. Lawyers are most important.
Are you talking of EB1A or EB1B? EB1A can be filed independently without employer sponsorship but the bar of approval is higher. For EB1B, you need employer sponsorship; however if you have decent publications with citations, it’s almost certain your EB1B will be approved (assuming your employer is willing to support your case saying they are offering you a research position).

I have an EB-1 green card. Because you have a Ph.D and a few publications will not guarantee O1-A visa status or EB-1. You will need to prove you are effectively a well known figure in the community with high research impact. Having your name mentioned in the media because of research you have done will help and so will having competitor companies worldwide reference your research as ground breaking will also need to be done.
