What's the plan if Immigration Reform (HR392/S281) does not pan out in 2018?

Indian currently stuck in the backlog since 2011.

Option 1
Leave US for place that offers more knowledge and growth and maybe come back on EB1.

Option 2
Keep waiting while the sun shines since all the stock keeps going up

Option 3
EB5? Considered but rejected -Not planning to spend 500k and buy the GC with an EB5 since with US born kids i get a GC anyhow in < 20 years now. EB5 also has additional +50-100k in lawyers fees

What's everyone else thinking?

I don’t care if HR392 passes or not. I am applying for Canadian PR the moment I start my full time job after I graduate. Will use my OPT happily and gtfo to Canada.

Your logic seems reasonable except the last step. Canadian citizenships won’t make US green card wait any shorter. Wait time depends on your country of birth, not your citizenship...

Yep , @GTFONow . GC is dependent on country of birth. Seen a few Indian citizens born in the Middle East who got their GC in a year.

I actually know someone who moved to Canada from India when they were 5. Person was in for a surprise when they applied for GC in US

Yes I’m Canadian and I can attest to this. The wait time is dependent on country of birth... NOT the country of citizenship.

But I’ve heard that there are some teams that will allow you to work from Canada on the TN and still stay on US payroll. This would be the ideal scenario. There are also other US companies that allow this (read: consulting firms).

So in short, no matter how you slice the pie, us Indian born folks are screwed when it comes to getting a green card 🤷🏻‍♂️
Let's buckle up lads, it's gonna be at least 3 decades before we can touch a GC🍻

Dang I feel for that brother from Canada though. Imagine growing up in the Western world where you are told you can be whatever you want in life, and USCIS punking you like that.

If you think any legal immigration reform will pass Congress, you really have learned nothing about the US.

Either leave or get married. There aren’t really that many options.

Thanks :) It's not a bad option since i've already made myself eligible for Social Security after 10+ years of working here. I could go work someplace else and get social security from there too :P

Perfect! I’m glad you understand. So tired of immigrants complaining that they don’t benefit by paying social security tax. They don’t benefit because they don’t stay here long enough.

Why do you want to live in the US? If there’s really no other option, couldn’t you leave and work in an international country for 1 year and come back on L1? I thought it’s easier path from L1 to Gc?

Of course this is considering if you’re an L6+ manager

    • Microsoft PMM’d
L1(B) does not have an easier path

L1A might, but you must be a people manager (most functional managers are seeing denials now). Anyways that’s about EB1 priority and it’s completely unrelated to L1 visas. That is: you could be here on a L1A as functional manager and still apply for GC in EB3.

I submitted my application for a tier 1 visa to the UK. Excited to see how that goes. In case anyone else wants to know how to do this, detailed instructions can be found at https://technation.io/visa/

My guess is that the majority will keep waiting for their fad to become current while others join the queue by filing new PERMs.
    Anyone think anything different?
