STEM OPT is ending August 2020, interviewing FAANG. One company’s lawyers are saying PERM will take 1+ yr and then 6 months to get EAD, so I shouldn’t apply for GC now. If I fail it will be hard to apply for Masters and get OPT again. But seeing 2-3 months for PERM posted online, and can get premium processing for I140 and AOS concurrently. (not Indian/Chinese) What is your experience with time it took to get GC EAD? Is it possible to transfer to other office for FAANG while GC is processing and come back when EAD is approved?
Submitting 485 on a non dual intent status can be risky
That’s a myth for the company lawyers to make extra money on H1. People who get married to US citizens do it all the time. As a matter of fact, you can go from any status to GC. There are time restrictions on it though. First of all, you cannot file a 485 within 90 days of your last entry on a non immigrant status. Secondly, as you can see in OP’s concern, your non immigrant status may expire before your EAD/AP combo card arrives in mail. You’ll be in AOS status but you cannot work or travel until you have the EAD/AP card in hand.
PERM shouldn’t take 1 year. 3-4 months if no audit, +3-5 months with audit.
Pls don’t mislead. The DOL pwd alone is taking 4+ months now (check the portal), followed by 60-90 days AFTER which one can submit for PERM, which takes 3-4 months. I’m not sure why you guys are not including the first 2 stages in the timeline
Can the pwd etc take shorter if the company is hiring year round? That’s what I heard for Google

Intuit lawyers were telling me it’s impossible to apply for GC from F1, and interviewing company seems to want to convince me to sign without negotiating GC so I lost my faith in them lol. Wanted to hear people’s experience
It’s very possible and the lawyer just wants to make extra money on H1 application. The only problem is what you’ve mentioned: timing! If your EAD doesn’t arrive in time, you’ll have to go on unpaid leave. This can affect the business and it’s a legit concern for your employer. But hey, a few months of gap ain’t gonna kill anyone.

What’s stopping you from doing both h1 and gc at same time?
I’ll be trying H1 for sure, but if I don’t get it and my F1 expires while GC is processing, it will be hard to get another F1 for masters approved
