Won the H1B lottery with sweatshop, later received offer from FANG

A sweatshop applied for my h1b and it was picked in the lottery. After sweatshop had applied for the H1b, I received an offer from FANG, but was later told I'd need to relocate to another country first and do a intra company transfer.

What would you do if you were in that situation?

TC at sweatshop 100k at a low col city
TC at FANG 200k in the bay area

I don’t think securing a h1b is easy if you join a sweatshop. Rejections are on high.

I've a BSc, lots of experience, salary in sweatshop is not that low... Not sure if the risk of rejection is that high

You already got picked in lottery. That is the difficult part. No rejection after that unless some rare case

Disclaimer: This is not legal advice.

You can join FANG sort of immediately in the US, assuming that you are already in the US. Alternately you'll have to wait till October if outside the US.

You just need the receipt number from the sweatshop's H1B application. (This will be in the I-797c, I-797a, and LCA. They are legally required to give you the LCA, from what I understand. Also, if you did a "change of status", the I-797a comes with the I-94 attached, and then they are legally required to give you the I-94 which also has the reciept number). Make sure you get the receipt number before saying bye bye to sweatshop.

You are already "cap counted", so you can just ask FANG to file a new H1B with premium processing for you, and you won't have to go through lottery again. Talk to FANG lawyer.

Ask the FAANG recruiter to wait. Get your H1 approved and then initiate the transfer. Spare yourself the misery of going through the lottery again.

In ur poll, 2 - correct it to receiving i797. Stamp is not needed unless you want to re enter in USA. 3 - dont so it. H1B lottery is unpredictable

Can't edit a pool once posted. For 3, it'd be an intra company transfer, so not unpredictable at all

L1 visa has lot of restrictions. If u already have h1b lottery, u shudnt leave it. Some fang companies like google may even wait few good months for you

One additional info: the sweatshop has contractors working at the FANG company, but the hiring manager at FANG told me he would rather hire directly as contractors usually think short term and don't do high quality work (he didn't know I was in the lottery with the sweatshop).

I would suggest taking the FANG. Cause:
    - Your H1B could be rejected
    - You will be miserable working for low TC at a sweatshop
    - There's not much harm to transfer to another country and then do intra-company transfer. You'll probably be on an L1 visa, but if the company can apply for your green card it'll be pretty good
    - Either way I think you get more options and brighter future at FANG, at least it's a name on your resume
    - If you're at the sweatshop even if you get your H1B I don't know if others want to hire you

      Disagree.
Read above. Get i797 and join fang. Lottery wont b needed again.
Why wud h1b be rejected now? That doesn't happen normally
L1b sucks. Getting green card is not easy at all with it. You wont get l1a easily unless you are a mgr. So don't think abt gc like this.
      Get h1b issue sorted first

My initial offer was for the US. The EU alternative was only offered once they realized I wouldn't be able to join anytime soon (not my fault, told them multiple times that before the interview)
