This is NY state. Is it legal for them to say this?
You take PTO on old job, start a new one, take a day off on new, come back to the old and give notice at the end if the day that this is your last day. Unless you are ok with losing your pto.
As far as I know they have to pay it out. But yeah, google is your best friend
You need to check the laws around your state’s last paycheck. If they don’t pay it out (whether they are required to or not) you could potentially take them to small claims court
NY state law requires employers to cash out PTO. Looking for any common loophole/gotchas that lets them get away with it.
Also I might want to work there in the future and hesitant to burn the bridge

I am guessing it’s a small shop, large companies usually don’t mess with that kind of things (its chump change to them compare to fines they can face)
It’s a big shop that’s going though sever budget pressures
File a complaint with the department of labor and irs
Lo want to work there again at some point in the future. There is so much power differential here.
