    It’s actually kind of disgusting to be using someone’s misfortune to advance their own selfish agenda. If the pregnant wife is really who you care about, ask for exception for her instead of using her to ask for things for yourself.

      For a person accustomed to privilege, equality sounds like oppression.

      Sure it does to you 🙂.

      On the other side, think of this - do no harm ensures everyone who has stake in the system isn't hurt. You are optimizing the problem for future immigrants who haven't set foot in the system and want to retain privilege against those who are waiting patiently for 15 years. It also doesn't give any privilege to any country, precisely because it sees everyone equal.

      If civil rights happened today, I guess you will ask to remain segregated until more schools are built for privileged, right? #separate isn't equal.

      Backlog can be fixed to 0 wait without increasing GCs by installing a points based system which kicks out the lowest scoring excess of applicants. But I bet you already know that. You just intentionally ignore it because it is not convenient to you personally.

      Google - I don’t think you are understanding that this has nothing to do with civil rights or race. It’s a per country cap, not a per race cap. The cap works now because it penalizes abuses form ICC. Just like how trade tariffs on China is punishment for their trade abuses. How about pressuring your government to fix your ICCs first before demanding rest of the world to suffer the punishment with you? Before you mention many people in the queue are not part of ICC, know that most people in China had nothing to do with trade abuses as well.

      What’s broken is not that there’s a country cap for gc, what’s broken is that there should have been a country cap for h1b as well.

      Yep we all know points based system - half the folks on backlog think that will pass soon and they will be able to get ahead of the line. Except that bill is DoA in it's present form precisely because it's intended purpose is to reduce family immigration.

      It was never designed as a bill to pass, but a partisan bill to posture - much like relief act that has no chance of passing.

      I can't go and fix anything in the system. If we want to fix ICC issues, should we also fix those RoW folks who get GC unskilled with 16k salaries. How did these abusers prove a below poverty wage in perm (US poverty for family of 4 is 25k)?

      Besides I can't fix abuse - that is exactly why I don't adjudicate petitions for h1 or GC. There is USCIS to do just that. Pinning abuse on me is as good as pinning abuse on RoW for all the abusers and asking not to issue any GC to any RoW until we kick out those below poverty GC approvals.

      But wait - let's talk about the RoW hypocrisy. People like you will shout abuse top of your lungs, but every bill that you supported till now - be it believe act, relief act - have no abuse prevention.
      S386 has h1 abuse prevention. You may claim it is toothless, but you also agree it was written for fixing abuse. Show me one provision in either of the bills that you support that has anything to fix h1 abuse. Unless your bills have anything like that, stop your hypocrisy. You have 0 locus standi to talk about abuse.

      I would have applauded you for being principled (even though I disagree with you) had you opposed both s386 and relief/believe acts. But then, that's row hypocrisy. 🤷🏽‍♂️ Is being principled that hard?

      Oh and don't peddle that h1b country cap. It can't survive courts, as it will go against EEO laws. The sad part is even if you want to do it, realities in Hill would mean you will be out lobbied by companies that it will be hard to introduce it, forget about passing it.

      I am not saying the country cap is same as civil rights. I am saying that country of birth is an immutable characteristic just like race. If you penalize someone for their country of birth, how can someone fix their issue?

      Don't ever try justifying country caps. Every senator who put a block on the bill actually removed country caps in their alternative unpassable proposal. House has already passed a bill with 365 majority (that's more than 4/5 of house). If anything, the ONLY thing all 100 senators agree on this issue is country caps should go.

      I honestly blame the companies who move all the good exciting opportunities here in the USA. We pay tax at top brackets and honestly most of the people don't want us here.

      Fyi: i am moving back in 1.5 years and will not file a visa extension.

      tghky: I am on visa myself and i agree with you. I think that Indians need to start thinking long term for themselves. It's not our responsibility to fix this country. I believe that democracy only work if you make them work. But as visa holders we have no rights and no voice. Also, comments on this thread prove that people do not wants Indians to get GC.

      I feel Indians who have not filled gc yet, should move to countries which are pro-immigration like Canada. Even if they might not have the best opportunities in the world but atleast we get respect and rights.

      Also, with the medical system and gun laws are so fucked up here . I don't even feel like living here anymore . Before i get any hate comments, i am leaving in <2 years.

      @amzn: whether to stay or leave is a deeply personal decision. You and I have no place in deciding to someone else to not stay here. People have various constraints - personal, professional and other reasons.

      If you don't feel like living here, that's your decision - own it and leave when you want. If it doesn't work for someone else, they will also move (as their own decision).

      'as a visa holder I have no voice' - I chuckle thinking about this when I see undocumented show up at townhalls. Ask yourself, how is an undocumented able to attend townhall and ask for help when our own folks on a legal status keep saying we cant ask for help. Our problem starts with awareness.

      Well I see many immigrants attending - even those who aren't franchised.

      Not sure if you know, your congressman hires a staff whose only job is to help with your immigration paperwork, like delayed EAD etc. That staff knows you aren't citizen. You should ask why is your congressman even doing that? The system knows this country is made of immigrants themselves and it's inaccurate to say you have no voice.

      Did you know for the house bill that passed with 365 votes, every one of the cosponsorship was obtained by a constituent on a temporary visa? They are folks just like you and me.

      Pending GC isn't related to his death. The point here is that the wait times are so long that there is a higher chance that someone in the line can die leaving their family out-of-status.

      In an alternate universe, his GC would have been approved in a timely manner and his family would have also gotten their GC as his dependants. Upon his death, they would have continued living here without having to uproot their lives.

      Diversity is racist against Indians because it does not allow Indians to get up to 100% by spamming the line with greater numbers. The system that gives more GCs to Indians than to any other nation is biased against Indian nation. People in the west hate dishonesty, every time you try to sell something like that you earn some more.

      This is RoW hypocrisy. He will keep saying abuse is bad and will paint a broad brush saying every Indian is an abuser, but every bill he/she supports doesn't fix abuse. How do you make a big deal about abuse but then go around and support bills that have zero provisions to fix them? Hypocrisy at its finest.

      Do you lack basic reading skills? The post doesn’t claim that he died became of long GC line. It’s the difficult situation his family is put through- wife is pregnant and can’t travel while her legal status is gone.

      Since husband worked here so long, contributed to economy, paid taxes like other immigrants, why should he wait longer than other immigrants? Country of birth has no place in employment based GC. Did your employer ask your country of birth before giving job?

      Against a company that has deep pockets and can hire amazing lawyers.? Sure that's a great way to get bankrupt only to find out that the employee contract covered it in some form. 🤷🏽‍♂️

      Suing a company with 100s of b market cap isn't easy. It's true that there can be payoff, but the risks are high. If she is working for another small company, FB can buy that company and fire her. They can work with her employer to firr her, I mean the choices are infinite. Once she is fired, she is out of status until she finds another job. Not saying FB will do that, but if they want to get ugly, they can, at huge losses for her.

      Why do you think many h1 co-worker works longer hours ? Many shady companies use their status as leverage to make them work harder.
