i94 - issues - tricky situation any one into similar situations
current employer’s h1 expires on 8/30 and i94 is valid till 10th September and so current employer filed extension in premium and received the reciept meanwhile i had an offer from another company , they filed h1b , start date is 9th September , h1b approval recieved as well , valid till September 2022 what happens if my current employer’s extension petition gets approved / denied will it effect my status ? what would be my status from 31st August to 9th September ? ps: reaching out to attorneys as well but want to hear out from folks in similar situation
What is the issue? You join new employer irrespective of current employer extension approval.
Will it impact my current status or i94 in any form ? Given that my i797 from current employer expires tomorrow, so the question was will my i94 which was valid till 10th September and secondly since the extension is filed in premium will it impact my status ?
With your transfert approval, did you receive a new i94 at the bottom of the I-797? Because if you did. There is nothing to do. You’ll be in status at all time.
Otherwise, you need to activate it. That mean going to another country and get another visa stamp.

Since transfer was applied before current h1b expiry and you have h1b extension in progress, you are good either way. Also note that 9th Sept is intended start date so you are allowed to even start before or after

Your new i94 on transfer petition should make your stay valid. Better try joining by 10th Sept and you will avoid all these headaches
