I recently just got layoff after working for 3ish months as a software engineer at a tier 2 big tech company (I do not work for Chase, but am merely using a friends old account for access to blind).

The layoff was due to reasons outside of my control and bad team management ( no proper training to learn about the code base and the internal system, could not get help for learning, assigned meaningless tasks, unrealistic expectation from the managements, upper management has favor for certain employees, etc ).

Company gave me one month of salary, one month of Cobra insurance as my severance package. I was wondering if I may have any chance of negotiate it to something higher like 3-4 additional months of salary, and a longer period of health insurance coverage. I have not sign the paper yet and have a little bit of time to decide.

I have some not so positive information on the management and was wondering if I could use that and the key points that I mentioned above as my negotiation leverages. Has anyone similar in my situation was able to negotiate a way better severance package on way or another?

Thank you for reading. My TC: used to be at poverty level compare to FANG people before the layoff, now it is none. lol

    So let me get this straight. You already talked to lawyers who said you don't have a case but you thought people on here would know something they don't? And you want to get paid severance for longer than the amount of time you were employed there?

    Unless you were fired on the basis of a protected condition (race, religion, veteran status, age, etc) or if it looks like that, then there’s not much you can do.

    If this was pitched to me I’d reduce my severance offer to 1 day.

      I have already spoken to bunch of lawyer about a possible wrongful termination case, but they say I don't have a case unless I categorized as a protected individual, which Im not sure if I am lol (complicated), one lawyer I spoke to mentioned not to tell the company that I am getting a lawyer since they could pull my existing severance package offer if I get a lawyer involved, as by getting a lawyer, I am essentially rejecting their severance package offer. what to do?

    It was 3 months! They don’t owe you anything. Put your energy into finding a new job. And that 1 month of salary won’t pay for enough lawyer time to get you another month of salary.

    I went through this as well. You might as well ask but be kind about it. They don’t owe you the severance, they can give you zero if they wanted. If you’re in CA, it’s at will employment, they can kick you to the curb whenever. They’ve heard the lawyer threat before, unless you’re very high level or have proof of wrong doing, it’ll be an uphill battle. Don’t forget, get nasty and they can pull it off the table. Be happy you get one.

    You worked 3 months - you’re at will employee, which means your company can term you anytime. You don’t have a case, blackmail them and you’ll end up blacklisted as no on wants to hire someone that sued their prior company, be a good leaver - you got a month, that’s reasonable considering you weren’t there long. And, if it’s a lay-off, they possible can’t afford more either way - move on. Don’t waste any more money on lawyers.
