i work as a graphic designer at a beauty agency, and am not making a lot of money. i am at 62k a year. i got a better offer and gave my two weeks. today is tuesday and my last day is this friday. i have 8 unused vacation days and they are only paying me for 3. i think its fucked up based off all the work i put in for such little pay. they are also making me train a junior level designer this whole week (my last week there). i am considered “mid-level” and they are trying to suck everything out of me before i leave, but whatever that is a separate issue. ive gotten advice from my father who is an Engineer and he told me to work this whole week to train new girl, but make next friday my last day on record so I can use those 5 days as “vacation” so in the end ill get paid for 8 days vacation that i didnt use. my coworker who i am close with is telling me to just suck it up and just take the 3 paid vacation days and just “loose” the other 5. my father who is more business like is saying the company is fucking me over. is anyone able to give me advice on what to do? i know i make so little compared to everyone else on here, but i appreciate the feedback.
Depending on the state you live in, they may be required to pay you out for your unused PTO. FYI some employers may not allow you to take PTO once you put in your two weeks notice.
If I was in your situation, I’d just take the hit and leave it be. Leave on a positive note. That will be far more valuable than a few PTO days.

Take your vacation time and use it as “reset” time as you prepare to start your new job. Obviously your current employer sees your value which is why they want to keep you around for as long as they can.
What state are you in? If you are in a state where they do not have to pay, do what feels and is right for you. Do you need them/want those 5 days off, or are you doing this with only the goal of punishing your employer?
I live in NYC, I would like a few days off before starting my new position, but I feel bad fucking them over and leaving a few days earlier than I said.

Take the days off. Not sure on NY laws, but it’s bad behavior for companies to act like this anywhere. You earned those days. You should get paid for them or take the time. You could always also politely ask—tell them you’d either like to be paid for your days off or you’re going to need to take them as vacation. Worse that happens is they say no and only pay you for 3 days—which is what’s already happening.
New York State it depends on written company policy. Suppose for instance the employee gets two weeks of vacation per year. Suppose it is granted in one lump on day one of the job and on each work anniversary afterwards, so new employees do not have to wait for it to accrue. Now suppose OP started on June 1st, and is leaving after 6 months. Should they be paid out for the full two weeks?
That’s a fair question in that scenario but, on the other hand, that’s the risk of a lump-sum policy. The company took that risk when they decided on that vacation policy. IMO it’s part of OP’s compensation and OP is totally within their rights to take the time or expect to be paid for it.
Well, if you wanted the vacation money, most people would take their vacation time and then give notice, so the last day ends on the last day of vacation.

this happened to me several years ago. Most companies say when your start in your employment agreement that your vacation accrues over the course of the year, so if you quit 2/3 through the year you would have only accrued 2/3 of your vacation policy. Most companies don’t care when you take vacation, this is simply a policy to avoid paying out vacation upon leaving. At 62k a year that 5 days vacation is not much, maybe $900 after taxes? My advice - a good referral 2 years from now when you’re looking for a job again is worth well more than $900. Don’t burn bridges over a small amount.

They're definitely fucking you over, but in a lot of states, paying out vacation isn't required. You'd have to check your state laws.
