work Visa (H1)

Im new to the sponsorship visa game. how does non-profit sponsorship for H1 work? what should be the starting point ? im aware it is cap-exempt, locked to non-profit companies only, but does it mean it has to be applied under regular cycle ?

Nope. Non-profits can apply for your H1-B anytime of the year.

If you arer working for a non profit, you can submit the application at any time. it's off from the cap.

Cap exempt H-1 can be applied at any time in the year. Usually Hospitals/University are non-profit entities, hence they can file under cap exempt when they hire alien foreign person. One important thing to note is if at any time in one’s career, individual goes through non-cap exempt H-1 visa lottery and it is approved, they can switch to-fro to cap exempt and non-exempt employer.

Meaning if I have H1 from Cerner then join non-profit, it'll be a 2-way street. If I have H1 from non-profit it'll be one-way . Correct ?

That’s right! If you want to go from Non-Profit quota to lottery quota, you have to apply in April for For-Profit H1-B

I didn’t knew this. Thanks a lot for asking this question. I also didn’t knew there was a cap exempt h1. This is very helpful.

USCIS has guidelines which specify whether organization is non profit or not. Does your organization fit in that criteria? I am planning to join non profit next month but it doesn’t fit into the criteria and my H1B will be in normal quota only.
