if i transfer from one faang to another, while on tn visa, is there a chance i can lose my tn visa/status?

i know youre allowed to transfer tn visa from one employer to another.

edit: Sorry, by transfer, i mean getting another tn visa with the other employer. will this affect my current tn visa in any way?

They will reject you simply for shopping POE, even if you aren't doing it intentionally.

They will ask why youโ€™re coming again when itโ€™s already been denied. They asked me that. I had to clarify that I was asked to come back with more info and wasnโ€™t told I was denied (I was specifically told itโ€™s not a no forever, just not for now- so try again with xyz docs)-the officer who had asked me wasnโ€™t there but I made sure to remember his name. They ran it by the manager, took in additional info and then issued on the second attempt.

Youโ€™ll need a new TN visa from the new employer.

    • I've been told if you get a hard denial your current TN is also lost, although I doubt this happens often. Make sure you have all your ducks in a row when applying and everything should be fine.

Depends on the reason for the denial. If it's based on YOUR suitability the may also the deny the current one. Always a risk.

But if the denial was based on the new job then it would not affect your current one.

You can actually have both at the same time.

You can get denied and banned anytime if you are software engineer. My friend got banned when he was re entering US. He wasnโ€™t even applying for a new TN. He already had a TN. He just had really bad luck that day and the officer started questioning him.

      that's what op means
      Nov 27, 2019
    • OP explicitly said "I know you're allowed to transfer TN from one company to another.." There's no such thing as TN transfers. Transfers mean you can start working on receipt of new petition. That's not allowed with TN.

To answer OP's question, theres not straight answer for this. For your new TN to be denied, there must be a reason, if there's some information mismatch they may check to see if your old TN had the same issue and revoke your old TN. When you say, if your new TN is denied, it really depends on the new denial reason.

You don't lose the current one. But be very careful about who and when you tell them you are switching jobs.
