Hello. I moved out of Cummins earlier this year. I am on H1B and Cummins had initiated my I-140. After I resigned I am asked to pay the I-140 processing fees around 2700. Anyone who changed companies on H1B had to do this? Thanks!
Don’t reply to these emails.
Wow. They're a bunch of penny-pinchers. $2700 for a corporation should be nothing.
It depends on the company. At the beginning of i140 process, if the company asked you to sign a payback agreement document for returning the fees in case you leave within a stipulated time (one or two years) after i140, then they ask you to pay back. Check if you had signed such a document.
Yes. I just found out I had signed that agreement. :(
OP, did they initiate or got it approved?
Is that the premium processing fees ?
No
I left cummins within a year after getting my GC and I had to pay the entire processing fee which was about 5k. Just for i140, that amount seems high..
They transferred the case to some collection agency. Would it affect my credit score if I don't pay them?
Please pay and get done with this.
Did they withdraw the I-140 after you left?
Unless its PP fees, its illegal to ask employee to pay for it. Ask them to write it in an email & you will consult with your lawyer on how to move forward with it. Of course, this is if you are ok with burning bridges.
Thats true for PERM not i140
Apologies, IANAL so coupang may be correct.
Bloomberg asked back.
