I am on H1 visa. I140 was filed with premium processing in March 1st week. I recently got a RFE on it.
My husband's F1 OPT will end July 1st week.
Our plan was to file for H4 + H4 EAD in April and for him to go on unpaid leave till his EAD is approved. But with my RFE, we cannot file for H4 EAD immediately.
What are the current H4 timelines given biometrics are not required? After July can he stay in the country if his H4 is still being processed?
Instead, would it be easier to exit the country and get his H4 stamped?
Will having a h4 already approved make H4 EAD processing faster?

H4 ead - you need to apply that only within the US. So once your husband comes back from india after his H4 stamp, apply for H4 ead. Itโd taking anywhere between 6 months to a year to get ead right now even after the removal of biometrics. We filed in October and still waiting and know folks that are waiting from last June (H4 ead).
In your case, did you get h4 stamp first and then file for h4 EAD separately?
