I am in a weird situation.. my manager in current company told a month ago indirectly to look outside for other opportunities as they are unhappy with me and want to replace me ..so I immediately went on job search and landed with 2 offers.. Company A is where I wanted to go.. but accepted Company B as well, just as a back up option.. Company B were very quick in Visa processing and my H1-B transfer got approved as well, but I pushed the joining date by 3 weeks telling some lame reason..just because I was waiting on Company A H1 transfer approval.. but Company A weโ€™re very slow in doing the paperwork and filing.. and ultimately I got Spec Occupation RFE..

Now I am in a fix what to do? By looking at the pace at which Company A lawyers have taken to file my petition , I am sure they will take their own Sweet time to file the response to RFE..Can I join Company B in the meantime and join Company A if RFE gets approved? I am confused because, if I leave current job and join Company B, there is every chance my current company will revoke my H1-B. So will this have any effect on the Companyโ€™s B transfer application ? My current job is hanging on thread

  • If you join company B, then when you want to join company A, you have to file for H-1B transfer again, since now your H-1B transfer would be from company B and not from your current company

      Join company B. When h1 from company A is approved move to company A . Give that will a slap for false info.

    • I had a similar situation a couple of months back.
      Consider the following scenario:
      Company X - Current
      Company A - New 1
      Company B - New 2

      Had an early offer from A, by the time Aโ€™s H1B change of employer(COE) was approved, I started submitting H1B docs for COE for B with Xโ€™s H1B 797.

      Lets say, on the day Bโ€™s petition was submitted, I submit my resignation.

      If thereโ€™s an RFE, could I have worked for A till Bโ€™s RFE was resolved without updating the 797?

      If not, what wouldโ€™ve been the way?

    I was exactly in same position. I joined the company B and left after 2 months once the RFE is cleared.

      Will company A application not get affected because current company will revoke the H1 that I have used for the transfer?

      Thereโ€™s nothing called transfer. Every petition is a separate petition to extend your status - even the one filed by your current company.

      So, donโ€™t worry.
