I’m a SDM at Multinational startup and can apply for both H1B and EB1-C. Which one would you recommend from GC perspective? I see EB1 is current right now? H1B to GC is going to take a lifetime.

  • Don't skip the line, wouldn't be fair. Go via H1B route

    • If you are indeed an EB1c material then you shouldn’t be scared. There is no such thing called “EB1C” directly. You need to come here on L1A and then file EB1C. So actually your question is plain stupid one. You aren’t alone a lot of EB1C going through this shortage of brain these days. Specially “start up” and “consultancy” ones.

    • Talk to a lawyer instead of people on here

  • First of all, we don't like 🥜 here. So, actual TC please.

Now, is that even a question to ask? EB1C via L1A is the way to go if you want GC in this life.

Also: L1A isn’t really required for EB1C right. Does not having L1 affect the outcome?

    • Yes it is not mandatory, you just need to meet all the conditions of EB1C. But L1A->EB1C seems to be most logical path.

These are not mutually exclusive. You can come on H1 and then apply EB1C. There’s no H1 to GC. You still apply in EB (employment based) category (1,2 or 3).

Why are you even thinking about H1B ? Go for the shortest path.

I have heard the EB1 rejections are high (30-50%) which might leave me in jeopardy

I would say that do some basic research first. Understand what different eb1 visa categories are present and then count in the rejection rate.

For example eb1A the individual must have sustained national or international acclaims for their contribution to their work. Obviously the rejection rate will be more.
Basic research skills should be there.

These arent comparable. You need a visa (h1b or L1 A or B) you can then apply for GC thru qualifying categories eb1c, eb2 etc. Eb1c is actually very fast and if you haven't lied much about the role etc, and the company has a good track record, you should be able to get it pretty easily.
