I am considering joining Amazon on receipt since the H1b approval process can take up to 6 months. I wanted to know what you guys think about my chances of getting rejected for H1b transfer. Here is my profile: -MS, Electrical Engg. and MBA from US universities. -10 years of experience in Electrical Engg firm in US, Never faced any H1b renewal issues, visa interviews at consulate lasted less 5 mins each time. -Approved I140 from current employer. -Wife has H4 EAD -Have a kid, who is a US citizen. -Job profile at Amazon requires electrical engineering experience with 6+ years experience. Your thoughts ? Appreciate your opinion . I will check with Fragomen, but i wanted a neutral opinion too. TC : 260k
As long as you are sure with defending rfe go ahead
Would you know for what reasons do one typically get an RFE and how is handled ?
The reason could be the officer woke up in wrong side of the bed.
There is always some risk.. but in that case Amazon should be able find similar role in Canada or any other location if you are up for it - good luck!!
Risk is too high. USCIS probably doesn’t care that you have an H4 EAD wife and a US citizen kid. If you are rejected your wife will lose her job as well.
Nor should they. Not their problem OP is taking an unnecessary and unforced risk.
I'm also joining on receipt. Can you tell me if fragomen gives their opinion? In my case they refused to take a stand
What do you mean by taking a stand, can you elaborate?
Like give you an opinion about what to do.
You can talk whatever you want and think whatever you want. At the end of the day it only takes some mad idiot to reject your h1b.
Agreed, what do you think would be the reasons to reject my case ?
I'm in the same boat as you are. Joining Amazon soon. But I'm willing to wait until approval. There doesn't have to be a reason really. To quote some though - uscis people not being technical enough to understand your work, being racist, psycho, or being lazy bastards etc. All these are grounds for rejection
So many good engineers lack common sense. Chance of rejection is low but there is chance your application might be rejected.. so why to take a chance.. if you have a job u can always wait 4-5 months to get approval.
I think it is more about the new company not being able to wait for that long
No
I doesn’t matter what others thoughts are nobody can guarantee you will get approval. You need to understand the risk of joining on receipt. On paper ur case does look good but based on current affairs you never know. Talk to amazon and ask them if they can wait, what your options are if things go bad. All the best
Nope. Amazon can wait
TC or GTFO
Oh Paypal is also trying to be cool
