The process is to invest in slightly risky projects, you will also get returns based on risks. The deal is that you get a gc in return the companies get investment at cheap rates, the public gets jobs. Win-win-win. But make sure you choose a project based on your risk appetite.
Note: you have to prove you have paid taxes when you earned those funds. This is the process for approving i526.
You file your i526 and they start processing, currently immediately because India is “Current”. Approval takes about 1-3 years according to a few users of this app. Once your application is evaluated, and approved you will have to file i485 if in the US, or the process for going to the embassy to file your application (something I don’t know)
Once your conditional GC is approved, you have to wait for 2 years to file for i829. This is the form to prove you have fulfilled your end of the deal of investing and creating jobs, and that the conditional GC should become permanent.
Whether you get your investment capital back, that is based on your project’s performance. If the project was unsuccessful, then your investment may or may not or partially be returned, but that’s not a part of the deal with USCIS. If the jobs are created you get your GC.
Now to the investment and how much it will cost.
- 900k if your project is in a TEA, an area in the United States where the employment rate is less than the National Average.
- 1.8M if your project is not in a TEA.
Additional Costs: If you are going through a Regional Center RC, then you have have to pay an additional 30-60k depending on the RC.
