Wondering if anyone has been thru the process of applying and getting it approved - would like to know the minimum requirements and how they built their case.. I currently have a valid I-140, but being Indian, it might take a while for the GC backlog to budge. In the mean time, I do not want to be at the mercy of lawyers to refile PERM / I140 for any change in job role or location - Also I do not want GC to be a reason for changing / remaining at job. Not to mention going thru the hastle of getting experience certificates.. Thanks in Advance.. UPDATE: I have a couple of papers and patents with citations totaling < 100 (but got some 50) last year. Have also contributed significantly to open source projects.
Wife got EB1A. The recommendation letters from people you haven’t worked with were a pain, essentially asking for recommendation from strangers. But good lawyer was worth it. Had money back guarantee for i-140. Did i485 in our own.
Good luck getting 485 approved, not sure what your story is but proving national interest is extremely difficult if all you have is some patents and citations
This was back in 2017, already got our GCs. EB1A not NIW. Also talk to a good lawyer, many offer free evaluations.
They take your case because they have nothing to lose. And they hope for the best. They have no confidence at all, it’s numbers game for them
Depends on your qualifications and background. Are you a research scientist with a PhD? How many of your main cited papers were you the first author? NIW is not extremely difficult, but you will need very good reference letters from experts in the domain. Find a good lawyer, and they can help you draft the recommendation letters.
I got my eb1b green card with no patents and 10 citations.. its not just patents or citations..
I got EB2-NIW, but it’s a slog and the bar is fairly high (got RFE, to which I responded with Fortune 500 C-level endorsements)
I recently got my NIW I 140 approved. No patents, no citations, no stellar references letters. I have founded startups in the US and abroad and have some press coverage to share. Every case is different, a good lawyer would make it.
Hey- can you please share the immigration lawyer you used?
What do you have to satisfy national interest requirements? Because if you can’t clearly share it it’s probably not good enough
