My husband has had several reports over the years who are going for their green card, and there's a part of the process where he has to post a job and then interview anybody who applies to see how they compare with his employee. He says they never have any of the required experience or skills, and they are never brought in for real interviews, and there isn't even really a job opening. What gives? Are the "applicants" actually just shills who work for the immigration lawyers or what? If it's a real interview, what happens if the person is qualified? Do they have to get hired and then the green card applicant is sent back to their home country? This whole process sounds super sketch.
definitely happens if the candidates are shit as expected, you get your foreign guy while being protected from unfair practices if one of the candidates actually turns out great, then you get a better candidate itâs a win win
It's all a sham. Here's how it works: You put up a posting with a far below market salary. No one good applies, of course. You hire the H1B and offer them the low starting salary. She negotiates up. You sign. Song and dance complete.

It is a sketchy process. They r doing it to go through requirements of USCIS and not to actually find a candidate.
What youâre describing absolutely happens. Itâs often a sham.
There is no such process. A lawyer certifies an LCA based on prevailing wage, industry, etc. Thereâs no concept of fake interviewing for each candidate. The company does have to survey the market before they can hire a green card or visa candidate, but not once theyâre already hired.
