Asked for visa status during interview

I recently gave an interview. Choosing not to name the company, but the first question in their last round of interview was "Are you on H-1B?" And second was "When did it start?". Even before the interview started. Just wondering how this isn't discriminatory? And how the EEO tag is just for name-sake smh!

  • It’s not discriminatory. The companies are required to fill the roles with citizens before they look at the h1b pool.

      So you honestly think they should put you before their business needs? It's just a business, if it doesn't work for them, it just doesn't. Not all companies have an option to offer you the job & wait for months before you can onboard. If you don't like their questions move on. And just learn to mention your visa in the first call & ask if they will sponsor.

    Lol, chill. Asking is not discrimination. Discrimination is when they reject you because of it. Some companies just don't sponsor (they have to hire lawyers and it's a lot of overhead cost). And the of the ones that sponsor, they ask so that they can know the timeline and your start date is usually asked so that they can plan around extensions or if it's expiring soon. If they have to fill the role in a week or so, they just can't get it done now, can they.

      I’ve been ghosted 3-4 times after having scheduled the interview because my h1b validity was less than a year. It’s disappointing as a job seeker and some of these roles are still open for more than 4-5 months.

      I don't think there's anything wrong. It's a lot more resources wasted for them than it's for you. If they didn't ask in the beginning, that means they can hire an h1b holder & don't have an immediate requirement. Its only to assess next steps.

    The ideal way would be the recruiter initially asking this question - all companies do not have the resources to get the visa transfer done, plus they do want to know the timelines regarding the visa so that they know about the risk regarding extending it. Once you tell them you have I-140 approved, it becomes less risky since visa extension becomes easier when you have that. But agree that this question should not be part of tech interview rounds. It should have been resolved before scheduling the tech rounds.

    Asking any question on an interview is discrimination. You probably wanted to know if it's illegal discrimination? IANAL but being a visitor has not been made a protected class yet, in fact, it's illegal to hire visitors without a special authorisation from the government.

    Nothing in EEO prevents people from rejecting applicants based on visa status.

    Nation of origin is protected class, visa status isnt.
