TN visa and switching employers

I'm thinking about switching companies (leaving a US company, going to US company) but I'm still on a TN. Can anyone comment on what the process is like in doing so?

What about LOA (leave of absence) rules at Amazon?

  • Your tn is immediately void when you leave your current job. You need to leave the country and attempt to reenter, applying for a new tn when you're at the port of entry.

  • Getting a new TN is super easy as long as the new employer is willing to do so. As someone said the TN visa becomes invalid when you leave, but that doesn't mean you can't stay while getting a new one, a visa is you key to enter, the I94 you are given when entering is your permit to stay, as long as the I94 is current there is nothing wrong with being here while processing a new one. I think you can get your I94 status online in the official immigration website.

    • Even more, as long as you don't leave the country for more than 30 days you don't have to surrender your I94 when you leave, so you could leave the country without a valid visa and come back using the same I94. But you would be at the mercy of the immigration officer understanding the law so I don't recommend it.

  • You can have multiple TNs. So get the new TN from the port of entry and after that hand in your resignation to your current employer.

  • Just go to the new company and when the TN comes up for renewal get a new letter. No one cares if a 51st stater is here.
