This happened in Redmond, WA. The automated car wash essentially almost ripped my rear bumper. They claim they are not at fault since there was prior damage already present. What are my legal options? I have already filed a claim with my insurance. Edit: I have no idea what happened while in the car wash. The rear bumper was pulled from the passenger side and there is a tear on it since rest of the bumper stayed on. That's the reason I say almost. This happened in brown bear car wash.
The car wash is NOT at fault, they normally have signage with that message on it. This needs to go through your insurance.
I don't know whether they are liable, but just having a sign doesn't remove all liability. You can put up a sign that says "Owner will shoot customers for any reason" but that doesn't mean they won't go to jail if the owner blows someone's head off
In this case it does, if you don’t like it you don’t use the car wash. Your comparison is invalid. It’s more similar to buying a ticket for a baseball game or sporting event. The disclaimer on the back about how they aren’t responsible for you getting hit by a baseball and hurt is clear. There is also signage and a announcements reminding you to “stay alert, balls and bats may enter seating areas at high speeds”
Many will have a sign saying they are not responsible for damage, but if negligence can be proven you may still be able to get damage paid.
Jesus. How is that possible? How weak was the bumper attachment to be ripped buy the car wash??? What happened?
Was the dirt and grime holding the bumper up? It’s not normal.

Unless you have a police report at the time of incident, it’s most likely on you and comprehensive insurance.
