What's my visa status F1 or h1b?

I am on stem opt and my employer applied for h1b last year for which I got a rfe few months ago. And yesterday I found out that it has been approved and I would soon be getting i797a. However I recently emailed my dso my stem evaluation report and she has not updated the sevis portal. In fact she made a change saying that my opt status has ended 2 weeks ago which I believe is the day my h1b got approved.

So am I now on h1b status or opt? If h1b what's the next step that I should take in order to keep my visa status?

  • Your status changed to h1b the day it was approved so you’re no longer on F1. Also you don’t need any stamping unless you leave US and re-enter. I have known people who have been here for 5 years but never got any visa since they never left after I-797 approval. Your DSO did the right thing by updating your sevis.

    • No! There is no EAD card for H1. Just the approval paper - I-797 notice from uscis. Use that to get/ renew your DL and other documents. Once you leave US, you will need to apply for a visa for re-entry. You will need to fill DS-160, pat the fee and appear for interview preferably in your home country.

      No, you wont get an EAD card. You can use i797 within the US for drivers license etc. But once you leave the country can't re-enter without a visa stamped.
