I need assistance. I am on a tourism B2 visa. I have worked for a marketing company as a tailor, doing activations at a certain retail store, located in NYC. It was an under the table job - no paperwork was filled. I have hired a photographer to take pictures of the embroideries I have done with this company's embroidery machine, so I could have my product portfolio once I'm ready to open my business. Then I quit this job, the employer wasn't paying me. I begin then focusing on building this business. I have posted the pictures on my website and instagram, as I'm starting my own embroidery business. Now this old company is requiring me to take out all the pictures inside this given retail store, claiming I was not authorized by them to post the pictures, threatening me with taking legal actions if I don't delete the pictures. I need help. And I don't know if this is the case for immigration lawyer or what kind of lawyer should I seek, if I should. You were working illegally and you didn't sign any contract with that company. What recourse do you have?
You reap what you sow. Come back on at least a B1 short term business visa then you might have grounds to defend yourself.
Do they know you were working illegally on a tourism visa? Because if yes, they have the ultimate leverage over you. One phone call and you're deported. You really don't want to go to court over anything, because any scrutiny over you could lead people to discover your visa fraud. You are super fucked. Do what your ex company asks and pray that they leave you alone.
Talk to a lawyer. Your past employer abused a tourist visa and from what you mentioned is a willful violator. Also, you need to be clear if you were paid by your previous employer for those designs, if you’ve used their facilities and/or equipment. Be sure to check if those designs are intellectual properties of that company. Some employers are bullies and a good lawyer can help you with them.
This would be applicable if OP had some sort of documentation of their agreement, which apparently they do not. Does the IP have any distinguishing characteristics that would be clearly known to you alone? Also, how are you putting up your new business -- is it a licensed entity? Are you still on a tourist visa? If so, you might have no recourse, unfortunately.
Willful violation of an immigration law by his previous employer makes OP a victim. The law protects him from such abuses and grants him relief in these and many other cases. He should see a good lawyer to protect his interests.
You would need an IP lawyer. The IP issue is independent of the work status and tax fraud issue. What is your objective? Worst case, you have to take down the material, pay back taxes and penalties, deported, and barred from reentering the country.
