Got EB3 Green card without being employed. Is this normal?

I filed my I-485 (eb3) in Dec 2020 through employer sponsorship.

Then, I lost my job at Google after my opt expired in Jan 2021. My plan was to go back to Google as a Xoogler once I receive my EAD card from I765. So, I decided to stay in USA and wait.

Didn’t get any update until now from I-765 after biometrics was done in June 2021.

In December 2021, I485 got approved and I now have my physical green card. Didn’t go through any interviews or nothing. I didn’t have a job throughout the whole year in 2021, and I received my green card.

I’m extremely relieved that I now have my Green card and start working again. But I don’t know if I have to worry about anything. It feels wrong because uscis probably think I’m still employed by Google. Is it normal to bypass the interview/i765 and get green card straight away? Any similar cases?

      I am not Indian, but it took me 16 years to get it. (J1 -> F1 -> Opt -> H1B EB3 -> H1B EB2 -> GC)

      Exactly. If you do that, and my wife did it while on a J1, then you are basically stuck in the US for the duration of the process.

      Just for additional context, a green card application can be filed for someone who is not even in US or does not have any kind of US visa or status. Even employment based ( It is a common process for family based GC) . That foreign national may or may not be employed with that US based company in 1 of their foreign / offshore offices.Essentially green card process can be started for someone for future employment as well.

  • GC is the intent of future employment, so I don’t see anything wrong here. Interview bypassing is a coming thing these days.

      I think this would have been a problem if interview then I would need to be employed by Google at the time of the interview.

      It’s legal to stay in the US while i485 is pending. You just can’t work or travel abroad.

    • I think you are technically right, but still amazingly lucky. I re-read and now understand the OPT expiration. And Google can re-hire you, they simply were not able to keep you employed, so unless there is proof they would not rehire you, even the interview could have been successful, maybe they would have asked Google for such declaration of intent to re-hire.
