I work for Microsoft and I have an offer from another company. My situation in the current team is not that great and I don't like the atmosphere and the culture. There is a chance that I might get I 140 approved by March. If I plan to switch immediately after I 140 approval, does Microsoft revoke it ? In general, I have heard that big tech companies don't revoke I 140 when you switch within 6 months of approval date. Does anybody know if this is true in person ?
in my case they did not.
Mind clarifying ? In your case the Microsoft did not “withdraw” do you mean the new company did not file labor and new I140 Sorry reading previous reply just got me confused
They won’t. Revoking is of no use to them.
What is I140?
When you switch companies within 6 months of I 140 approval does the new company file I485 asap or wait until 6 months oass
Can someone reply to this question! TIA
No they won’t, but I think in some cases the i140 will not be transferrable. No reason for them to revoke your i140.
Could you explain this a bit ? What are some of the common cases when its not transferrable ? As this will be my first I 140 approval, I will be using this to extend my H-1B term by 3 years.
Microsoft does not revoke I-140. There is no transfer concept. Your new company has to apply h1 with the copy of the I 140 approval from Msft. Then they need to do labor and 140 again for GC
Legally, they can't revoke it if you stay 6 months after approval. However most corporates don't revoke even if it's sooner
You have to confirm with your attorneys! As you mentioned, big companies don’t revoke but it depends on the company though!
