Does the affirmative action concept apply when hiring?

lets say candidate X is a minority in tech and scored a 4/5 on the interview and Y is not a minority and scores 4/5. Candidate X gets the offer but Candidate Y doesn’t. Does this reflect reality? I know the laws state otherwise. The reason I ask is because companies always are striving for a more diverse workplace. disclaimer - i am not against nor for either, just a curious person

This wouldn’tz be legal, but there may be a few timid hiring managers who who don’t have the guts to stand up to HR and may prioritise diversity hires with similar interview scores to look good.
