I am on L1B, and I have H1B picked and approved for consular processing by the same employer, but I have not gone back to home country to stamp h1b at the consulate, so status is still L1B. One recruiter reached out to me and I started interviewing. He checked with his immigration team before starting the process, and told me that I am good to start but he did not give the details how visa transfer would work. I am positive to get offer based on interview feedback. I want to understand what are the options here for visa transfer in case I get the offer? Has anyone here done this before successfully? In couple of weeks I will be able to talk to their immigration team after getting offer, but I want to know from people in here cause waiting couple of weeks is just too long. TC - 200k
Active your H1B does not require to stamp it on passport. New company’s lawyer can file document to change status for you. The stamp is only needed when you leave US and come back. Was in L1 in MS and activated my H1 to join G.
Thanks!
Best ask an immigration lawyer. Other option let the new company apply for h1 and if approved go join.
Thanks for the response, I will talk to their immigration lawyer in couple of weeks, after the offer is finalized. But I wanted to know first hand experience and options before that.
If u r in bay area I can refer u to an immigration attorney. (charges around 500) if u r impatient.
