If H1B transfer gets denied, does my time in the country end right away?

I have an H1B with company A. I accepted an offer at company B. Company B filed an H1B transfer for me and I have an RFE on that. Should the RFE get denied at the end, does my H1B with company A also become invalid? What if company A, out of spite, goes and informs USCIS that I no longer work for them. Will that amount to my H1B becoming invalid?

    Company A will not know that company B is doing a H1B transfer for you unless you tell them. So you can continue working at company A as if nothing happened in case the transfer fails.

      Can you guys help me understand something, say company B applied for my transfer and it got confirmed. Then after that I give my 2 weeks notice? What I don’t understand is is company B provide a date of the transfer effective date? Or when it get confirm we can talk about the starting date?

    Hi all, I am still not clear about something. If I decide to join company B with an RFE and the RFE gets rejected, I am obviously going to try everything that company B can do for me... Refiling, sending me to canada etc, but if nothing works out, do I still have my 60 day grace period to look for another job in US? How important is it that I negotiate the shit out with company A that they don't revoke my H1B with them after I leave?

      Yes you do have 60 days period to find another job if you have unexpired i94.

  • Is your current company willing to extend your notice period to say 4 weeks ?

    To answer your question, if the current company doesn't revoke your petition right away. Your 60 days grace period kicks in. Unfortunately we have no ways to assure that.
