Blind as you may have seen someone wanted to know how to take action against s386. It was flagged and taken down. Then an informational post about s386 was created and that was taken down again. Here is gist: 1. Contacting senators starting from your state by meeting in person,emailing,calling. 2. Going to and organizing protests. 3. Joining anti s386 organizations. Pro S386 folks, taking and flagging down anti posts will only make matters worse and simply prove the fact that minority voices will be choked if this bill passes. If you truly believe in s386 let people speak against it. Edit: Appreciate pro s386 blinders for not flagging.

If India was only sending SKILLED workers there wouldn't be a queue. It's not the people who can get into Amazon that created the backlog. It's the zillions of stuffed shirts who have no more skill than zillions of Americans but are willing to be paid less that come in via Wipro, Hcl, Infosys, etc who work in the "IT Dept" of non tech companies.
It's no more a big issue with those consulting companies. Those companies have 70 to 80% of rejections on H1 and L1.
Honestly the long waiting period for Indians is partially caused by a combination of H1b fraud and streamlined ICC abuse of the policy. S386 will increase the amount of people in the queue significantly as the streamlined ICC will produce more.

I think i dont undestand why people are saying that it would kill the diversity. Arent those people who are going to get the green card if this bill pass, already working in the country and their sons/daughters going to school? Or is this bill for people who are trying to get into the country?
The bill removes country of birth from list of high skills. And those affected by the backlog are already in the US.. many for decades. Highly educated with at least a college and university degree. They pay taxes and their children go to schools. Regardless, OP seems to have issues with people from Indian origin.
It kills diversity because the streamlined ICC will pushing enormous amount of low skilled people into the pipeline through the continuous fraud and abuse. This leaves little chance to others.

The GC cap failed at what its supposed to do. It doesn't work when only 2 countries have lines 10 years long while other country quota are going empty each year and spilling the unused quota to other countries. It defeats the purpose. In today's global economies, You can't and shouldn't control people coming in based on their nationality. Over the past 10 years, Indians and Chinese are the largest recipients of GC anyway.
Why does that defeat the purpose? And why shouldn't we control people coming in based on their nationality? That is EXACTLY what the cap is meant to do. We do want immigration from a variety of places, not all from one country. But the real problem in my opinion is that the standards are too low and that allowed India to send a large number of economic refugees as "consultants". This then blocks up the queue, delaying visas for the actual skilled immigration from that country. If we got rid of the economic refugees coming from India and only brought in their high skilled then the cap wouldn't be a problem-they don't send enough high skilled to exceed the cap anyway.
Look around in any US city where tech had flourished in last 30 years.... The majority of GC were given to Indians and Chinese only. Because there wasn't much demand from other country quota to even fill their quota. Those also get spilled over to India and China in the end. So how do you say GC cap worked? Entire neighborhoods and cities in bay area have been transformed into Asian and Indian neighborhoods. Just look around. I agree to you on the other part. Standards are too low, but that's a separate unrelated problem that needs to be solved.
There is literally no reason to oppose this bill, unless you are someone who wants to retain their privilege on an immutable characteristic like country of birth. There is a famous saying For the person accustomed to privileged, equality sounds oppression. You are an individual applicant just like me. On an employment GC, where my GC is given for my skill, my country of birth has no place. My country didn't conspire to send me, nor do I represent my country on a skills visa. For diversity: There is exactly a visa for that - it's called diversity visa. Look it up. Employment Visa has the word employment in it for a reason, it's for my ability to work. Also note that, hiring someone for their country of birth is illegal. Again in all these questions, the MOST important question to ask is, how does this help American workers. The answer is this bill removes lower mobility worker, there by reducing wage depression and increasing wages for all. Basic labor dynamics tells us that when there are 2 class of people with different labor mobility, the system chooses the cheaper one (the one with lower mobility). When these lower mobility workers become more mobile in the labor market, they will be chosen less, because they are no more cheaper. In effect, this reduces further diversity erosion and also increases diversity. If you really care about diversity, and prevent an American worker being passed up for a backlog employee in hiring, you will support this bill.
Yes, a person cannot control his place of birth. It is also not necessary that a person's place of birth is where he grows up or creates his identity. I am an Indian and grew up with a friend from age 3. We graduated, passed out, came to US to work. My friend got his GC because technically he was born in Nepal. His dad and mom just happened to be there when he was delivered. Otherwise he has never gone to Nepal, for everything else he is an Indian. Now how do you justify him getting GC and me in a 10 year line justifies the purpose of the GC cap. My friend is as Indian as me for all practical purposes.
@Cisco, no justification is required. US gov sets the rules, so you either play the game or you don't. You are not in the position to ask for justification because it's not your country. It seems like people are trying to convince everyone including foreigners to support or oppose this bill, while they neglect to focus on the most important people to convince, which are actually people who have a say, hence Americans and their politicians.
