F1 OPT/STEM OPT to Green card
Hi all, I’m currently - in my 7th month of first year OPT - Will be applying for STEM extension in a few month. If approved, my OPT won’t end until January 2024. My employer is willing to sponsor me for a GC starting January 2022 (once I’m on STEM OPT and once I’ve been with the company for 1 year). The immigration team already told me that I shouldn’t be too hopeful that this is going to work out given that PERMs are currently taking so long. I‘m from Europe (ROW), so from a non-backlogged country. Been in the H1B lottery this year but didn’t get picked in the first/second selection :/ Any thoughts or similar experience anyone? I wonder too how realistic it is that Biden‘s 2021 citizenship will go into law. I guess that could make things a lot easier as far as dual intent and f1 extension during green card process. And they call people from backlogged countries "visa abusers". There couldn't be a more blatant violation than going from f1 (declared non immigrant intent) to green card lol.

It should be fine (cutting it a little close). There are going to be travel restrictions until you trash a certain stage though. Around 1year for your company to start the process, do recruitment, apply for perm and get approved. After that you do concurrent filing for i140 and i485 along with an application for EAD and advance parole travel document. Another 6-12 months and you get your GC EAD and advance parole travel document. Hopefully your OPT doesn’t expire by then.
what happens if the OPT expires before this process is finished? Can company relocate you and continue with the process or no?
OP, I am currently in your position. My company started mine 2 months after my STEM OPT started. My PERM was filed in April 2021, so I am hopeful it will be approved next month (as long as no audit). I'd say go for it. I have had no luck with h1b so getting 1485 EAD by the time my STEM OPT expires next year is my hope now
