My wife and I are expecting a baby in 2020. She works for Oracle too. What is the policy at Oracle reg FMLA in Washington state, can she take additional weeks off on top of the 12 weeks given by Oracle. Are we eligible for FMLA on H1B. When you work at one of the top companies, you don't worry about FMLA, because the benefits the company gives exceeds what the law requires. To answer your question, though, the unpaid leave required by the FMLA runs concurrently with the paid leave the company will provide. If the law provides for additional job-protected leave thats longer than the company provides, yes, she can take it, but it will be unpaid.
