Can people on h1b visa take furloughs/ temporary work hour reduction?

  • You have to get the monthly minimum H1B salary for your position which is 90K to 130K/annum based on the state you work in. You cannot take furlough as you won’t get paid... temporary work reduction is possible only if you still make the h1B salary requirements.

      Yes but there is no such thing as monthly minimum, it is wage rate either hourly/monthly/annual, h1b can’t be paid less than that

      If you meant prevailing wage then wage offer made in petition can’t be lower than prevailing wages but whatever wage rate approved with petition, employer is obliged to pay

  • Anyone know if folks on Stem OPT can be furloughed and still remain "employed" ? If yes, I assume it counts towards their unemployment days (150 total OPT + STEM)

    If furloughed, can Stem OPT folks claim unemployment ?

      After company announced Friday furloughs for unlimited time, I told my boss being on H1 and unable to work a side gig on furloughed day. It was 20% salary cut essentially, He told the thing to HR and HR ended up increasing my salary such that after 20% cut it came about to my current back then,
      Any law? Buddy your 129 petition has wage rate employer committed to pay and any major wage changes need amendments. If you’re a full time 40 hours employee then to furlough you company needs to file amendment to changed hours. Anytime company is not following what is in petition, they are violating law.
