I am an sde and looking to move to US. I have a few patents under my belt and am wondering if my GC can be applied in EB1 category? I am an Indian citizen and hold US degree. Would love to hear examples if you can share any.
Do you have Phd?
If (s)he did, they wouldn't have asked this question
OP did not specify which degree (s)he has 🤷🏻♂️ Couldn’t assume anything !!
Yes.. you can give it a shot with patent ... but distant though.. if you published papers and have more citations you got a good shot..my friend is an SDE he got EB1.. he had published papers that had lot of citations..and my friend had masters from tier 2 university ..you never know until you try it.. I suggest you to talk to attorney and they can help you through..
Thanks, this is helpful. I did talk to an attorney and they were not 100% sure either and advised I come to US first and then they will see. However I want to go to US only if I can be assured of EB1. With this GC uncertainty, Canadian PR doesn't sound like a bad idea. Thoughts?
Spent 6 yrs on h1b and giving up. Got Canadian PR and moving to Vancouver
Do you have publications with citations? You don’t need phd for eb1b.
EB1 GC is not a patent to PhDs only, if you have a masters degree with patents in application, you have a case. Butt if you have only a bachelors degree, that would be challenging to make a petition for EB1.
It's interesting that managers from India with no prior US education or job experience can apply for eb1c and get GC in a couple of years. And an sde who even has higher degree from US, has patents will take 15 years in eb2. What an irony :-)
Nothing about immigration is fair. But you did know this, why not be a manager for sometime in India and come back here?
That's not an irony, but yes, it sucks.
Nope
