What happens if one quits a company while on H-1B and decides to move back to their home country?
Can they come back at a later time and get back on H-1B? Will it be a simple reinstatement? Or will a new company have to do H-1B transfer? What is the expiry of that H-1B?

    I have seen people resurrecting their H1B after years after leaving the country, if they didn’t complete their 6 years after getting selected in cap subject pettition

    If you are still under 6 years of maximum allowance, you can have any employer apply H1 for you cap exempt(no lottery) and you can come back. Since its new employer sponsored you need to go for stamping and then return to US

      I’ve completed around 2 years on h-1B now but want to know if I have this as a backup option to come back after 2-3 years

  • You are cap exempt for 6 years of your h1b. Don’t have to go through lottery again. When you come back, you get the amount of unused time back.
